Bicol Autonomy Movement (BAM) updates

The oratorical contest on Bicol autonomy has been successfully completed in three provinces: Albay, Camarines Sur, and Camarines Norte. The champions from these provincial eliminations (including the winners from the upcoming eliminations in the Provinces of Sorsogon, Masbate, and Catanduanes) will be competing in the regional championship!

A research paper on the economic viablity of Bicol autonomy will be completed soon. It explores the various economic variables that affect the performance of the region within the broader national context. BAM will sponsor a public presentation of the initial findings this month!

BAM expresses its gratitude to the Coalition for a Citizens Constitution (C4CC) for inviting us into their national consultations on charter change and regional autonomy. Bicol autonomy was presented in Cagayan de Oro City, DAvao City, Tacloban City, and Naga City.

Our gratitude also for the individuals, organizations, and institutions that took part in the focus group discussion on Bicol autonomy conducted in Loyola Heights, Quezon City. Your ideas and inputs will become part of the working draft of the proposed Charter for the Bicol Autonomous Region!

And last, but not the least, our gratitude for the legal minds within the Bicol Autonomous Movement that will draft the working paper locating the BAM advocacy within the broader context of charter change.

A new province emerging from Camarines Sur?

There is much discussion on the possibility of a new province emerging from Camarines Sur. At the moment, it has taken on the form of a proposed legislation in the House of Representatives and in the Senate.

Eventually, it will be subjected to a ratification by the constituents of the affected province. As such ratification draws closer, the people are once again challenged to understand and analyze the issues involved.

We can only hope and pray that the people will vote guided by a critical and intelligent understanding of the issues at hand. Otherwise, it will again be a battle between vested interests unabashedly appropriating and aligning the talking points to their own personal, political agenda.

Death penalty in China

Three Filipino citizens separately arrested in China and convicted of drug trafficking will be meted the death penalty today. Elizabeth Batain, 38, Ramon Credo, 42, and Sally Villanueva, 33 will face China's harsh punishment for drug trafficking.

Unfortunately, the Philippine government cannot intervene in the judicial process of a sovereign state.

And worse, the lessons implied by the fate of these Filipinos reflect the state of poverty of our countrymen, the extent of drug syndicates' operations in and out of the country, and the quality of protection our government provides for the Filipino people.

Apalling dimensions of poverty continue to haunt our people, both in the urban and rural areas. Lack of food, shelter, education, and livelihood are some of the most common experiences. In this situation, hundreds of thousands Filipinos have opted to work abroad in the hope of a better life. Unfortunately, it is also at this point when predators such as trafficking syndicates descend upon our impoverished people. And so many of our poor people indeed become captive preys, devoured and torn to pieces.

At the same time, we realize the extent of drug abuse problem in this situation. It is not a problem that is localized in the Philippines. It goes beyond borders. In fact some drug syndicates may even parallel perhaps the leading transnational corporations in the scope and extent of their operations. It is not also a problem that is concentrated on one sector. It transcends social stratification.

And even the government is affected when you have a lawmaker caught overseas with illegal drugs!It is not surprising then that "narco-politics" and even the prospects of a "narco-state" is becoming a very clear, alarming scenario for the Philippines.

The fate of Credo, Batain, and Villanueva reflects the quality of protection the government provide our citizens. In the Philippines, we cannot prevent drug syndicates from smuggling drug mules out thru our airports and sea ports. And when the Filipino citizens exploited by these syndicates are trapped in other countries, we go begging for mercy!

When will this cruel cycle end? How many more will have to die in foreign soil before we become more competent in protecting our citizens?

Impeachment Trial

The Senate again! This time acting as a tribunal to decide on the impeachment case (which the lower house overwhelmingly endorsed) against the Ombudsman!

Im tempted to say I have seen this before and I have heard this before - in the impeachment trial of former President Estrada. But maybe that will be very simplistic and sweeping. After all, this is a different senate in terms of composition.

But still, I am apprehensive about the process. The simple process of deciding on the rules may take forever. There are also many possibilities for a deadlock in the trial process, like what happened to the "envelope issue" in the Estrada trial. Will this case warrant a popular mobilization if it gets to that?

Or will President Aquino's alleged popularity and influence again come to play, as it did in securing positive votes for the impeachment in the Lower House? This I will be monitoring closely as the trial nears.

Many analysts are now starting to scrutinize each senator and examine the prospects of a conviction. Including that of Senator Lacson. But everyone seems to be wary at this point and no concrete pattern is discernible.

What can be perceived from this predicament is the prominent divide between the allies of and former President GMA herself on one hand, and that of the incumbent President Noynoy Aquino on the other.

Who will prevail?

Senate Investigation

As the daily media coverage of the on-going Senate investigation into alleged anomalies in the military bombarded my senses, I cant help but get a certain feeling of dejavu. Been there, seen that...?

Consequently, these questions pop up in my head: Where is this investigation, with all the media hype, taking us? What legislative measures, if any, will be enacted after this investigation is completed? What will be the predicament of the personalities involved, both the accused and the witnesses?

And relating these questions to previous senate investigations,where have those investigations taken us, aside from the daily media attention generating public opinion? What legislative measures had been enacted, upon being "aided" by those investigations? What has become of the witnesses and personalities paraded in front of the television cameras and splashed into the newspaper frontpages?

Thinking aloud now, I believe we should be a little bit more critical of the processes being undertaken in the legislature, and a little bit more demanding on the accountabilities of senators and congressmen to the Filipino people.

After all, these democratic institutions (such as the legislature) are supposed to be the agencies through which our will as a people is expressed, formulated, and carried out.

The Lacson "Strategy"

Philippine Senator Lacson's action, wherein upon learning of an arrest warrant issued against him, went "underground" and "resurfaced" only when the said warrant has been quashed, provoked mixed reactions from citizens of the Philippines.

But to my mind, this is a painful illustration of how even the country's justice system can be perceived as subjects of politician interests and maneuvers. As Lacson himself, a senator of the republic, competently demonstrated by his actions.

Lacson refused to be subjected to the legal process in a context wherein the political leadership is an opponent. Does it imply that the court can be used by malacanang, or whoever is in power?

Lacson resurfaces after the warrant has been quashed, and a new political leadership is in place. Does it imply that the court then can be used by malacanang, or whoever is in power?

This scenario has left me wondering: How do we really insulate the country's legal system from partisan politics?

If we cannot do that immediately, the Lacson "strategy" may very well be a popular "legal" strategy.

CAMPAIGNS AGAINST DRUG ABUSE IN NAGA CITY

NAGA CITY LAUNCHES COMPREHENSIVE PROGRAM FOR THE PREVENTION AND CONTROL
OF DRUG ABUSE, ESTABLISHES THE NAGA CITY DANGEROUS DRUGS BOARD!

The Naga City Government, under the leadership of Mayor John Bongat, recently launched its comprehensive program for combating drug abuse in the city. The Naga City Dangerous Drugs Board (NCDDB) has been constituted and activated to coordinate and implement the various projects and activities under the city’s comprehensive antidrug abuse program.

NCDDB is composed of directors and heads of concerned government agencies, department heads of the local government, and representatives of the academe, religious, private sector, and NGO/PO.

NCDDB shall serve as the exclusive policy-making, monitoring, and coordinating body on the prevention and control of drug abuse in Naga City. It will execute programs and projects for formulating and implementing short-term, long-term, and sustainable solutions to the drug abuse problem.

The City Mayor is the chairman of the Board and Hon. Raoul Rosales has been designated as Presiding Officer. The Board shall constitute among themselves an Executive Committee and at least three Working Committees focusing on the following areas: (1) public information, campaign, and education; (2)intelligence, enforcement, and prosecution; and (3)early intervention and rehabilitation.

After having conducted two(2) consecutive meetings, one in November 2010 and another in January 2011, NCDDB is scheduled to be meeting on a quarterly basis.

The operations of the NCDDB shall be supervised by its Executive Committee through the Secretariat.

LIFE IMPROVEMENT THRU FRIENDLY EDUCATION (LIFE) COUNSELING CENTER NOW OPEN
FOR DRUG ADDICTS AND CONCERNED RELATIVES IN NAGA CITY!

Anchored on the compassion for the victims of drug abuse and as a support mechanism for those who are concerned with the predicament of drug addicts, the LIFE Counseling Center is just a phone call away! Alternatively, a more personalized face-to-face interaction with volunteer counsellors can be conveniently arranged.

The LIFE Counseling Center was created by Naga City ordinance No.2001-065 authored by then City Councilor and now Mayor John Bongat. It calls for the establishment and operation of a center that shall provide “confidential, competent, and reliable counselling services to drug users who have not yet reached the stage of drug addiction or dependence and are ready and willing to totally abandon drugs and return to normal life.”

The Center shall provide the following services: (1) provide free, confidential, competent and reliable counselling to drug users, particularly those who have not yet reached the stage of drug dependence; (2)refer to appropriate government agencies for rehabilitation, after compliance with procedural and judicial requirements, clients who can no longer be treated by means of counselling; and (3)recommend to the NCDDB such measures to improve the services.

The operations of the LIFE Counseling Center shall be managed and supported by the Naga City Dangerous Drugs Board (NCDDB) thru its Early Intervention and Rehabilitation Committee.

CITY GOVERNMENT PUSHES FOR THE CREATION
OF THE BARANGAY ANTIDRUG ABUSE COUNCILS (BADAC)

Barangays are the local government units directly affected by and confronting the consequences of drug abuse-related problems. Along this line, the Naga City Government is pushing for the creation of the Barangay Antidrug Abuse Councils (BADAC) in the city’s twenty-seven barangays.

As mandated by Memorandum Circular No.98-227 of the Department of Interior and Local Government (DILG), BADAC shall be composed of the following: Punong Barangay as Chairperson, Barangay Kagawad /Chairperson of the Peace and Order Committee as Vice-Chairperson, SK Chairperson, School Principal, Barangay Tanod Executive Officer, Representatives of NGO-PO, Parents-Teachers Associations, and Religious Organizations as members.

The primary role of BADAC is to plan, implement, and evaluate drug abuse prevention programs. Consequently, it shall be a mechanism for: (1) coordination of existing and planned services and programs, (2)obtaining funds, volunteers, facilities, and technical expertise, and (3)performance of other related responsibilities as may be assigned by competent authorities.

Initially dubbed as “Action Against Drug Addiction”, the Reorganization and Orientation Seminar of BADAC was conducted last August 11, 13, and 20, 2010 at the Naga City Youth Center. The seminars featured lectures and inputs from the DILG officials and anti-drugs advocates in Naga City.

Majority of the barangays in the city have already reorganized their respective BADAC’s. A city-wide general assembly of all BADAC members shall be conducted on 28 February 2011.

A representative of the BADAC shall sit as member of the Naga City Dangerous Drugs Board (NCDDB).

Election, election, and election!

2010 is election year indeed!

The sycnchronized national and local elections was conducted in 10 May 2010. Then a few months later, in October, the election for barangay and Sangguniang Kabataan officials was also held nationwide.

The CASURECO 2 also conducted elections for its Board of Directors from the districts of Calabanga, Canaman, Milaor, and Tinambac/Siruma in November 13. This was followed also by a similar elections for CASURECO 1 Board of Directors!

The SK and Liga ng mga Barangay then elected their federation officials December 4 and 7 respectively!

Whew! Election season indeed! 2010 is election year!

RENNE F. GUMBA is presently the Executive Director of the Institute of Politics, Ateneo de Naga University. He is also a faculty of the Political Science Program in the Department of Social Sciences of Ateneo.
Mr. Gumba is a well- known political analyst. A favourite resource speaker for many trainings and conferences among non-government and government organizations. He is a well-travelled lecturer, having taken part in many conferences in the local, national, and international level.
His work experiences included stints in the Ateneo Social Science Research Center as a Research Associate, in the House of Representatives as Political Affairs Officer, and in the Ateneo de Naga as faculty of the Social Sciences.
Mr. Gumba took AB Political Science and graduated magna cum laude and valedictorian of the Ateneo College Graduates of 1992. He was a consistent first honor student From Kinder to High school, and completed both his elementary and secondary education as the Class Valedictorian in the Naga College Foundation.
He was also a seminarian in the Holy Rosary Minor Seminary Pre-College Formation Institute and eventually joined the Jesuit Pre-Novitiate Program in his college days. He is now married and has three children.

CONFRONTING THE DRUG ABUSE MENACE!
Naga City has organized the Barangay Anti-Drug Abuse Councils (BADAC) in the city’s twenty seven (27) barangays. BADAC is mandated by a Memorandum Circular from the Department of Interior and Local Government (DILG). The officers and members of BADAC will soon be taking their oath to be effective instruments in a community-based approach to combating the abuse of illegal drugs.
The initiative to re-orient and set up BADAC was undertaken by Mayor John Bongat with the assistance of city councillors Raoul Rosales and Rey-An Cedric Rentoy. The City Government is also assisted by the Naga City peoples Council and the Institute of Politics of the Ateneo de Naga University.
An ordinance that created the Naga City Dangerous Drugs Board (DDB) is also being reviewed by the Sangguniang Panlungsod . The DDB is expected to coordinate, plan and implement various anti-drug abuse programs.

WHY BICOL AUTONOMY?
Some people are wondering why there is BICOL AUTONOMY MOVEMENT (BAM) in spite of the perceived shortcomings in the country’s autonomous regions.
I wish to cite at least two considerations glimpsed in recent discussions why autonomy is still an option: (1)some of the autonomous set up in the country are really intended as anti-insurgency mechanism and did not effectively generate the consensus of the people towards autonomy, and (2)no genuine autonomy was really granted to the regions.
Thus, for the BAM to be effective, autonomy must be born out of peoples’ consensus, generate development directions, and provide meaningful economic as well as political autonomy.

BIDS AND AWARDS COMMITTEE (BAC) MUST HAVE OBSERVERS!
The Government Procurement Reform Act (GPRA) has mandated, among others, the creation of BAC with observers from the civil society, non-government, and peoples organizations. It also required the posting of the notices related to bids and awards in the PHILGEPS, a web portal for all government procurement transactions. Unfortunately, this is not consciously observed by many local government units and government agencies.
The initiative of the Procurement Watch Inc. to network with other organizations nationwide and train BAC observers to be effective in their mandates is a welcome initiative. The Naga City Peoples Council and PWI had trained and deployed observers in the BACs of several agencies and LGUs in the province since October of this year.
There is now a clamour for more organized network of trained and accredited observers that will provide institutional support for observers, including legal assistance in cases of anomalies and irregularities in the bidding process.

WHAT AILS OUR ELECTRIC COOPERATIVES?
Much has been said and done about the predicament of the electric cooperatives. But still, there is a lingering sense of trouble and unease, particularly among the consumers. Where is this coming from?
Many of the things that bother the consumers come from what they do not know. And in this area, a lot can be cited. Is the CASURECO2 a cooperative? How does CASURECO2 conduct its projects and procurements? What is really the role of the consumers in CASURECO 2?
Many of the things that bother the consumers also come from what they know. Consumers are paying high electricity cost partly due to incompetence of some leaders in electric cooperatives. Many contracts are entered into without the awareness of member-consumers. Elections, it seems, are influenced by entrenched politicians. And as far as consumers are concerned, they are made to feel like mere end-users or “buyers”, not owners of the electric cooperative.

The consumer group supported four(4)candidates to the Board of Directors of CASURECO 2. The election was conducted in Calabanga, Canaman, Milaor, and Tinambac/Siruma. In the end, two candidates emerged victorious.

Much can be said about the election process. Be that as it may, the challenge is again in the continuing struggle for consumer empowerment.

But first, gratitude must be expressed to those who supported the campaign. A lot was accomplished although a lot more remains to be done.

CASURECO 2 MUST SERVE AND PROTECT THE CONSUMERS!

The CASURECO 2, with all the other electric cooperatives nationwide, was created to render electrification services to the consumers. As such, all other concerns whether internal or external to the cooperative, are subordinated to this primary goal: acceptable, efficient, and effective service delivery of electric power to the consumers! The cooperative’s board, management, and personnel must NEVER be beholden to anyone but the consumers!

Unfortunately, CASURECO 2 has been persistently plagued by issues and controversies ranging from the interference of politicians, misdemeanors of officials, misconduct among the employees, to instances of unhealthy labor-management relations and poor customer service.

At present, the cooperative is again in the limelight of controversy due to the significant hike in the rates charged to the consumers without even the semblance of consultation or information-sharing. As expected, the consumers are outraged by this single sweeping act. And when other allegations of mismanagement and irregularities started to surface, the people have to rage and rise against the perpetrators of these unfortunate predicament of the cooperative!

The BICOL AUTONOMY MOVEMENT strongly supports the clamor for significant changes in CASURECO 2. We join with enthusiasm the struggle of the people of Camarines Sur and Naga City for a more affordable rate and a lot more efficient e electric power service delivery.

We call on the concerned government agencies, specially the National Electrification Administration(NEA) and the Energy Regulatory Commission (ERC), to act decisively on matters brought to their attention by the aggrieved consumers.
We call on the concerned CASURECO 2 employees to exercise judgment and act according to their conscience – and fight for the consumers which they are supposed to serve!

Finally, in the long term, we call for the dissolution of these electric cooperatives and the setting up of a BICOL POWER CORPORATION that will consolidate and harness the power potentials of our region and dedicate itself to the affordable and efficient delivery of electrical power to the Bicolano households and industries!

We hope for a better CASURECO 2. But most importantly, we will work and struggle for a better and more progressive Bicol Region! Thus, if these electric cooperatives cannot do their share, then let us do away with them and come up with our own unique, distinct Bicolano mechanism for power generation and distribution!

CEAP/BACS in the 2010 national election

A consultation meeting with the Bicol Association of Catholic Schools(BACS)-member schools(represented by their respective Directors for the Office of Student Affairs) was conducted 10am-12 this morning at the Board Room of the Ateneo de Naga University.

Represented in the meeting are the following schools/universities: Ateneo de Naga University, Universidad de Santa Isabel, Sta. Clara College, Divine Word College of Legazpi City, Aemilianum College and St. Louise de Marillac College of Sorsogon City, Liceo de Masbate, and the La Consolacion College of Daet, Camarines Norte.

BACS, as the local chapter of Catholic Educational Association of the Philippines (CEAP), is preparing to mobilize faculty, personnel, and students for engagement in the 2010 elections.

Fr. Joel E. Tabora SJ, President of the Ateneo de Naga University and of the BACS, attended the consultation meeting. Atty. Minetta Estanislao of the Archdiocese of Caceres Council of the Laity and the PPCCRV Coordinator for the archdiocese was also in attendance.

The Catholic Educational Association of the Philippines (CEAP) is undertaking nationwide mobilization of volunteers from its member-schools to watch over the conduct of 2010 elections.

The Bicol Association of Catholic Schools (BACS)is promptly gearing up for this mobilization.

Initial consultations were conducted between the Institute of Politics of Ateneo de Naga University and the Parish Pastoral Council for Responsible Voting (PPCRV)of the Archdiocese of Caceres. Both organizations are currently engaged in various voters education initiatives in preparation for a mobilization towards the 2010 elections.

An initial meeting/planning of the Student Affairs Directors of the BACS-member schools from all the provinces of the Bicol Region will be conducted on Tuesday, 23 February, at the ADNU Board Room. Among the agenda will be the presentation and discussion of the CEAP guideline for mobilization of volunteers from schools and universities.

The University Social Involvement (USIC) - Committee on Socio-Political Education and Involvement (CSPEAI) and the Social Sciences Department of the Ateneo de Naga University (ADNU) teamed up to hold mayoral forums entitled Safeguarding 2010 and Beyond: Getting to Know the Candidates last 18 February 2010.

The first of the two forums was held at ADNU’s Gymnansium from 9-12 o’clock and featured four Naga city mayoral candidates – Atty. Adan Botor, former City Councilor Luis Ortega, Incumbent City Councilor Atty. John Bongat and former City Mayor and former Camarines Sur 2nd District Representative Sulpicio Roco.

The forum was divided into three parts. The first part gives the candidates 20 minutes to answer key issues on Governance, Environment, Economics, Peace and Order, Education, Arts and Culture and Social Services. The second series of questions came from the panelists composed of Office of Student Affairs (OSA) Director Atty. Jo Aileen Cabiles, Arts and Sciences faculty member Bernadette Gumba, Noel Amador of University Student Recruitment Office (USRO) and Ateneo Personnel Club (APC) and Jose Rizal Model Student Chanelle Anne Allorde. For this part the candidates was given only two minutes to answer questions. The third and last series of questions, pre-screened by a technical board, came from the audience consisting of students of Naga city. For this part the questions range from the pertinent “What’s your stand in the RH bill?” to the revealing “If you won, will you appoint one of your rivals as city administrator? If yes, who will it be?” The question which solicited much interest and applause from the crowd was “If you’re not running, who will you vote for among your rivals?”

The second forum was held at Instructional Media Center (IMC) form 1:30- 4 in the afternoon. Resource persons for the event were mayoral candidates of the municipality of Pili composed of former municipal mayor Tomas Bongalonta, incumbent municipal mayor Romy Salazar, Atty. Noreen San Luis and Dexter Morano.

This forum likewise followed the three section format. Panelists were Deputy Academic Vice president for Formation Janet Badong-Badilla, OSA Director Atty. Jo Aileen Cabiles, Noel Amador of USRO and APC and Glenn Fabia of the Supreme Student Government-Student Tribunal.

Elmer Abad III served as the forum’s Master of Ceremonies.

The event was meant to educate voters. Over 800 participants joined the two forums.

The year 2009 ended splattering with blood the road towards the May 10, 2010 election. The whole year of 2009 recorded a total of 33 election-related violent incidents. Conventional security observers would readily say the numbers are insignificant in the context of the whole year round and too early to conclude that the incidents are election-related as there might be other factors or motives of the acts of violence.

The numbers may be insignificant but something to be taken seriously especially if one has to look beyond the numbers. The acts of violence are planned with clear targets and clearly election-related.

Of the number of incidents, there are 84 fatalities and 40 wounded. The high number of fatalities shows that the objective of the acts is not simply to sow fear but to kill. Especially that among the victims, twenty-two are politicians (13 killed and 9 wounded) planning to run in the election; 9 security aides of the politician-victims (7 killed and two wounded). Other victims are active supporters, allies and political operators of politicians. Election officers were also targeted with 2 dead and 2 wounded.

Civilians comprise the bigger number of victims (58 fatalities and 27 wounded) but less than five of these are accidental victims or were caught in the crossfire. The majority of them were also targeted and acts of violence against them were planned. The fatalities were mostly victims of the heinous massacre last Nov. 23 in Ampatuan town in Maguindanao perpetrated by the political warlords – the Ampatuans. Most of the wounded were victims of grenade throwing and strafing at the line of voter registrants that occurred simultaneously on the same day in Lanao del Sur.

By geographical distribution, the island of Luzon accounts for 15 incidents, while the Visayas had 6 and 12 in Mindanao. In Luzon, majority of the incidents were in Masbate, Isabela and Quezon. Samar island contributed most of the incidents in the Visayas. In Mindanao, most of the incidents were from Maguindanao, Lanao del Sur and North Cotabato.

Does the above mean a violent and bloody scenario in the months going to the election? Others hope that the number of incidents in 2009 will reduce the number of incidents during the 2010 election period as political scores have been settled “unfortunately in a violent way.”

Others may say, that looking the above information the other way is pessimism or sowing fear. The intent here is to call all concerned to act on the matter.

The last quarter of 2009 alone had 16 incidents of the total 33 the whole year. Does this mean that while election fever heats up, hot blood for violence also boils high?

The problem is that contributing factors of election violence remain. For a number of traditional politicians and vested interests, election is not about competition for position but a war for political power. Political dynasties and warlords still abound
and election is the time for expanding political turf and/or settling old score among warring political clans. Despite the PNP campaign last year to control the proliferation of loose firearms, there is an estimated 700,000 unlicensed firearms all over the country. There are 170 private armed groups the police force is running after outside of the other armed criminal groups and political armed groups whose services are readily available to violence-oriented candidates and political operators.

The 2010 National and Local Election is a historical period for the Filipino people. The election is about re-strengthening electoral democracy and more importantly looking forward to the next decade. Elections can be fair and free without violence and coercion. It is time to exact political and electoral costs to the perpetrators of violence and charge them of the consequences of their actions like the Ampatuans of Maguindanao and former Abra Gov. Vicente Valera. All election stakeholders and centers of legitimization like the Bishops, the Ulamas, the police hierarchy, the election officials, the media, the academe, the private sector and civil society formations should join efforts at containing election conflict and violence. Everyone must go beyond partisan interest and call the attention of all candidates and parties to play according to election and security rules. xxxx

Security Advisory on Comelec Checkpoints

Guidelines on Comelec Checkpoints:

1. The Comelec/AFP/ PNP Joint Security Control Centers (JSCC)
checkpoints must be established in well
lighted areas with visible sign boards in coordination with
city/municipal election officer. It shall be
supervised by local Comelec Election Officer.

2. It must be done in a manner that will impose minimum
inconvenience upon person/s to be searched such
that the rights of the persons are not violated.

3. PNP/AFP personnel manning the checkpoints must be in complete
uniform with nameplate and led by an
officer with a rank of at least a Lieutenant (AFP) or Police
Inspector (PNP).

4. Valid search on vehicles must be authorized by a search
warrant issued by an appropriate authority.
Warrantless searches can only be conducted on the following
circumstances:
a. Moving vehicles and the seizure of evidences in plain
view
b. As long as the vehicles are neither searched nor
their occupants subjected to a body search, and the
inspection of the vehicle is merely limited
c. Vehicles where occupants appear nervous, suspicious
or exhibit unnatural reaction
d. If the officer conducting the search has reasonable
or probable cause to believe that either the occupant/s is a law
offender or that the instrumentalities or evidences pertaining
to the commission of a crime can be found in the vehicle to be
searched
e. On the basis of prior confidential information which
are reasonably corroborated by other attendant matters.

5. PNP Police Operation Procedures shall be strictly observed
particularly in situations where search, seizure
and arrests are made including the use of reasonable force
against violent aggression.

6. Any person arrested must be turned-over to the nearest police
station, together with the arrest orders and
receipt of confiscated items. The police chief /detachment
commander shall conduct an investigation and
submit a report to the provincial or city prosecutor for
preliminary investigation.

7. All arrests shall be immediately and chronologically recorded
in a logbook.

Some helpful tips when flagged down at checkpoints

1. Upon approach of checkpoint especially at night, slow down,
dim car headlights and turn on cabin
lights. If pulled over, open window three fourths down.
Greet AFP/PNP officer, note name of the officer
and maintain contact.

2. Lock all doors; talk to AFP/PNP officers only on one side of
your vehicle. Ordinary/routine questions may
be asked. Be courteous but firm with answers.

3. Only visual search is legal. You are not obliged to open
glove compartment, trunks or bags.

4. Never step out of your vehicle. You should not be forced to
alight unless there is probable cause to believe
that your vehicle has been involved in a crime.

5. Keep your driver´s license and car registration handy, within
reach and ready for inspection when
requested by authorities.

6. Be ready to use your cell phone at any time. Speed dial
emergency numbers.

INTRODUCTION

As we celebrate the motherhood of Mary, we reflect on her faith and how her role in God’s plan. As the Mother of Christ, she is also the mother of the Church. Devotees of Our Lady of Peñafrancia know this by heart. Thus, we lovingly call her Ina.

It is indeed fitting that the solemnity of the Motherhood of Mary is celebrated on the first day of the year. Ina is our hope and our refuge. As we begin another year, we are filled with new hope because we know that our Ina continues to journey with us.

This year, the national and local elections also signal new hope. It is an opportunity for our people to express their will and to contribute in charting the country’s future. Indeed, democratic processes are meant to uphold the dignity of the people and to lead every person towards a significant participation in the community.

The technology of automation gives us reason to be optimistic that the election will reflect the people’s true will. We are hopeful that through this automation, fraud in the counting of votes will be appropriately addressed and minimized. By their vote, the people entrust the reins of government and their votes bear their hope for a better future.

But this hope for a better future needs to be coupled with a commitment to vote for leaders who will promote the common good. Elections emphasize the sovereignty of the people. To vote is not only a duty as citizens but as believers of Christ.

Every person, when casting his or her vote, makes a moral decision where the welfare of the people is at stake. The lives of the poor and marginalized, the pursuit of justice and peace, the progress and development of our country – they are shaped by the decisions made on election day.

Time and again, the Church has called upon the faithful to follow their conscience so they may cast a meaningful vote. The faithful must not allow the election to be a battle of campaign slogans and media exposure. The hope for new beginnings cannot be pinned on impressions but rooted in fortified conscience.

To follow one’s conscience requires enlightened conscience. It must be attended by a pursuit of truth, and a discernment of God’s message in concrete circumstances. When minds understand the realities of the present and when hearts are attuned to God’s will for all His children, the people’s vote can truly pave the way for a country where common good is the vocation of its leaders and where democracy leads to the integral development of the people.

It is therefore crucial for every faithful citizen to truly understand the political situation of our country.

The Political Landscape in the Philippines

In Rerum Novarum issued in 1891, the Church has denounced the concentration of power upon a small number of very rich men who “lay upon the laboring poor a yoke a little better than that of slavery itself.” (RN, 3) This aptly describes the evil of oligarchy.

Sadly, this situation persists in our country. Philippine politics has all the characteristics of an oligarchy.

Our country’s democracy is a mere semblance of real democracy. The basic freedoms seem to be present such as the freedom of speech, freedom of association and religious freedom. But the most important freedom – the freedom to be an empowered people – remains to be a dream. When the majority is not equipped with an empowering freedom, there can be no genuine participation from the people.

This empowering freedom is elusive because majority of Filipinos live below poverty line. There can be no government of the people, for the people, by the people if almost all Filipinos are poor. Poverty deprives our people the opportunity to develop their potentials, renders them incapable to participate in public affairs and denies them the primacy of the people in a democracy.

The rule of handful elite families negates democracy. Democracy and oligarchy cannot co-exist. The long-standing poverty of the majority of the people is a continuing result of oligarchy. This is evident in our provinces. The stronger the oligarchic powers in a locality, the poorer are the people.

The national and local governments are run by handful elite families of around 300 in the whole country. According to the latest Social System survey, only one percent of the total Philippine population belong to the ruling class that craft the social, political and economic life of the country. On the other hand, only 9% belong to the middle class while the great majority, 90% of the population, belong to the lower class.

The ruling class enjoys more than half of the nation’s wealth. They rule the country by provinces, congressional districts, cities and municipalities. Their hometowns are their political bailiwicks. They allocate political power unto themselves. The consequence: a proliferation of political dynasties and politicians clinging onto power either directly or indirectly.

Behold some of the striking features of an oligarchic politics:

Election Fraud and Violence. Illegal voter registration, intimidation and undue pressure of voters, vote buying and vote rigging (dagdag-bawas) are prevalent in both local and national elections. Election-related violence such as killings, kidnappings, physical attacks on rallies, homes, offices and vehicles of candidates and supporters are widespread. Intimidation, coercion and harassment usually precede the physical violence. Ruling families build up private armies and hire goons not only for protection but also for intimidating opponents. The Plaza Miranda Bombing in 1971, the murder of Evelio Javier in 1986, the murderous rivalry of the Espinosa’s and the Kho’s in Masbate are examples of the worsening election violence. On November 23, 2009, the world witnessed the worst election-related violence and it happened in Maguindanao..

Costly Campaigns. Campaigns become more expensive when competition becomes unduly intense, when economic stakes are high and when electorate continue to expand due to population growth. Tri-media advertisements are used not only during the campaign period but every single day. Personalities and celebrities are paid millions to endorse candidates as if the candidacy is a merchandize of consumer product. Vote-buying is given a sizable budget in any campaign, as if it were a legitimate expense. Campaigns are bankrolled by businessmen making candidates vulnerable to business interests at the expense of the common good. Heavy spending is done by the government to prop up administration candidates who seek re-election or election to other posts.

Political Turncoatism. Turncoatism or the switching from one party to another is another feature of Philippine politics. With the absence of marked differences in ideology, platforms and programs, shifting allegiances are commonplace. Political leaders easily jump from one party to another because their choices are centered on personalities rather than on platforms and programs. Factors considered are: party resources, winnability and networks. An ally can be an enemy the following day, not because of solid principles but only for political expediency and convenience. This indicates an absence of true ideals. Political parties are not institutions of ideologies and values but are mere machineries to facilitate campaign.

Quid Pro Quo Politics. What binds or unbinds our political leaders is quid pro quo politics. “Something for something.” Quid pro quo politics is also called transactional politics because governmental powers and authority are used for undeserved gain. Political leaders enter into arrangements with other politicians, deals that will benefit both of them. This exchange of favors is self-serving; it is detrimental to common good. Quid pro quo politics pollute the integrity of government institutions because checks and balances are undermined. These are instances when the chief executive exchanges favors with legislators. The examples are legion: scam in different branches of government, the circumvention of laws and the failure to prosecute graft and corrupt practices are abetted by quid pro quo politics. The fertilizer scams, the ZTE deal, the questionable creation of new congressional districts are but recent manifestations of this political culture among political leaders.

Extrajudicial Killings. Extrajudicial killings include “disappearances” where people are abducted, never heard from again and a body is never located. The killings’ desired impact is fear, paralysis and the breakdown of organizations that are vocal in its opposition and efficient in mobilizing public protest. Most of the victims are members of genuine party-list organizations such as Bayan Muna, Anak Pawis and Gabriela. The establishment of the party list system enabled sectoral groups to be represented in Congress. Their increased electoral success has posed a credible threat to the domination of the ruling class. According to Human Rights Watch, 110 members of party-list members have been killed in 2001 to 2006. In Bicol, students of Bicol University, Camarines Norte State College and Aquinas University have been killed in 2006 and 2007. Their killings have been linked to their membership with the League of Filipino Students.

Power Hoarding. Perpetuating one’s self in elective posts has been a tradition among many political leaders. Many incumbent politicians endorse bench warmers when they reach term limits. This way, they can easily reclaim their posts after three years. Others simply shift from the executive branch to the legislative branch such as from being governor to congressman or mayor to congressman and vice-versa.

HOPE IN THESE TROUBLED TIMES

The seemingly insurmountable issues of our political landscape have caused many Filipinos to focus on personal godliness and to distance from communal responsibility. Indeed, hopelessness has crept in and has weakened the Filipino spirit.

Our faith calls us to look upon the cross that redeems us. In Spe Salvi, Pope Benedict XVI said that to have faith is to hope. Jesus’ teachings represented a serious political challenge to the authorities of His day and for that, they crucified Him. But His faithfulness to the Father has revealed to us God’s perfect love. Accepting our responsibility towards our brothers and sisters is a public expression of our faith. To continue to hope for peace, justice and equality of human dignity is faithfulness to the Father’s will.

Hope for People Empowerment. Aristotle, in his book Politics, called democracy the best form of government. However, he pointed out that there can only be democracy where the majority comes from the middle class because virtue can only breed in people who are neither so rich nor so poor. The wide gap between the rich and the poor obstructs authentic democracy because a master and slave relationship reigns between the leaders and the citizens.

With a vast number of Filipinos, generation after generation, living under massive poverty and with the handful elite running the country, we must admit in humility that there is no genuine democracy. There is an urgent need to confront this truth so we can hope for the right kind of change.

To hope for democracy is to hope for the creation of a middle class. And the middle class can only be created when there is genuine people empowerment.

The middle class, as poetically described by PCP II, “is neither so poor that they have nothing to give nor so rich that they have nothing to receive.” But more than income and resources, the middle class is identified by their attitude towards and participation in society. The middle class has the means to be self-reliant and can break away from mendicancy or dependence from the ruling elite. The middle class is an empowered people who can positively influence the social, political and economic life of our nation.

Rerum Novarum affirms the dignity of the working class and defends the right to private property, to organize associations, to just wage and just working conditions, as well as the right to religious freedom. These rights must be respected to provide an environment conducive to people empowerment. Populorum Progressio affirms that authentic development must be complete, that is, it must promote the good of every person and of all humanity. Pope Paul VI beautifully stated that: “…there can be no complete development of individuals without the simultaneous development of all humanity in the spirit of solidarity.” (PP, 43) On helping the poor, he firmly commented: “You are not making a gift of your possessions to the poor person. You are handing over to him what is his. For what has been given in common for the use of all, you have arrogated to yourself. The world is given to all, and not only to the rich.” (PP, 23)

Therefore, I invite you to reflect together as ecclesial communities how you can contribute to people empowerment and the creation of the middle class through education, capital and ownership in the light of the Church’s social teachings.

Schools can expand scholarship programs as a concrete response. Educational institutions should include programs that will enhance special and competitive skills that can assist the poor to generate income to fend for their families. The culture of dependence can be at least minimized if the poor can find in themselves the capacity to conquer their own poverty. Schools must equip the poor to be creative so they may become productive citizens of society.

Those who are engaged in evangelization can uplift the dignity of the poor by making them aware of the nexus between poverty and political maturity and engaging them towards concrete actions that will integrate them into society. At the end of the day, evangelization cannot be complete when it is found only in motherhood statements. Jesus’ message is not limited to personal morality. The cross does not only look up and down at the morality of each individual human life, but also looks across the horizon of collective and social responsibilities of human lives. Evangelization must strengthen its prophetic voice and find relevance in the context of our people and the many issues that undermine human dignity.

Many government institutions remain silent about the right to private ownership, the reason why the people remain to be property-less. The right to shelter has been responded to by providing temporary dwelling, contingent upon the re-election of the incumbent and his allies. Through evangelization that teaches God’s will for an abundant life for His children, the poor will be led to an appreciation for the value of paying what is necessary to guarantee private ownership across generations. Payment in the form of blind loyalty or unreasonable debt of gratitude to the incumbent perpetuates patronage politics and holds hostage human dignity.

Those in the social development sector must endeavour to promote self-reliance among the poor. It has been proven that dole-outs breed dependence and subvert efforts to uphold the equal dignity of men. Social development programs must respond not only to the apparent needs of the community but must look into the structures that prevent authentic development. These programs must then provide venue for meaningful participation in the community, with the overarching goal to empower the people and assist them bring about their own advancement. Social development programs must aim to create an environment that will allow all men to fully develop and live as God’s children.

Civil society must assist in halting the vicious cycle of dependence by providing venues for people to associate and become more aware of the movements that impact their lives. Analysis of and understanding social, economic and political forces will help our people to position themselves against insults to their dignity. Filipinos must have the ability to distinguish between values and events that promote their empowerment and those that lure them into continued dependence. Only when we possess such clear distinction can we move towards true people power and democracy.

Hope for Social Justice. While people empowerment is an essential requisite for democracy, the virtue required to create and nourish democracy is social justice. The equal dignity of human persons necessisates the effort to reduce excessive social and economic inequalities.

Bridging the gap between the rich and poor, the powerful and the marginalized, the elite and the lower class – this is the essence of social justice.

As prescribed by Pope Pius XI in his encyclical Quadragessimo Anno, social justice is a virtue which requires personal responsibility to transform social institutions. This virtue calls for a commitment to social change. However, many social ills hinder the concern for our society. Among them are individualism, consumerism and materialism. These ills lead to the escalation of sinful inequalities.

When we are concerned only about our family’s welfare, when we accumulate material possessions excessively even if through legal means, when our lives are measured by the income and properties we acquire, we create greater inequality between rich and poor. To be socially just, we must stop caring only for ourselves and justifying our indifference by saying that after all, we do not step on another man’s shoes. We must begin looking at our lives as a member of our community.

The founding of the Kapatiran Party is evidence that there are among our lay faithful who are committed to their role as members of the Church in the society. In the Kapatiran Party, we find among our lay faithful a deep concern to restore integrity in politics and a sense of community among our people. This concern could only be inspired by their faith. Their participation in the 2010 elections may be an uphill battle but it is a concrete sign that the hope for social justice is alive.

Social justice, however, can only be fully realized if the state recognizes it, when the right social and economic order is established by the supreme authority in society. Without these structures, social justice is impossible in our country.

We need to examine the source of the discrimination of the poor and marginalized so social justice can be truly present as a feature of government. Through active engagement and solidarity, we can open new paths towards a society that respects the equal of the dignity of the rich and poor, the powerful and the marginalized. But we need to start with ourselves by asking how we can effect change.

Gaudium et Spes urges for civic and political formation so that all citizens can play their part in the life of the political community. All citizens, most especially the youth, must learn the art of politics to work for the common good and fight all forms of injustice and tyranny, as well as arbitrary domination by an individual or a political party. (GS, 75)

We need to build and enrich civil societies. Free associations guarantee the well-being of the society. Civil society must find a voice because when power is in the hands of a few although able and competent, social justice will not prevail.

Social justice as a virtue can be expressed in many ways. When we bring to the public forum the condemnation of prostitution, jueteng, illegal logging and quarrying; when we hold our political leaders accountable for graft and corrupt practices, lavish lifestyles and abuse of power; when we organize ourselves to protect religious rights, the integrity of families and the life of the unborn, every time we exercise our civil and political rights to perform our duty towards the common good, we practice social justice.

Social justice is charity that has matured and deepened as a public response to Jesus’ message. Charity does not end in providing material goods. It demands even the provision of conditions that will enable the people to obtain what is due them in the light of the Gospel.

I make this special appeal to the businessmen and entrepreneurs to look to higher values than profit. Quadragessimo Anno states that “Every effort must therefore be made that fathers of families receive a wage large enough to meet ordinary family needs adequately. But if this cannot always be done under existing circumstances, social justice demands that changes be introduced as soon as possible whereby such a wage will be assured to every adult workingman.” (GA, 71) Here, the Church has made the distinction between minimum wage and living wage.

I call upon the capitalists to aspire for profitability with genuine care for the welfare of their workers. “Business management cannot concern itself only with the interests of the proprietors, but must also assume responsibility for all the other stakeholders who contribute to the life of the business.” (CV, 40) True relevance of business undertakings is found in ensuring that the enterprise is a means to serve common good.

Hope for the Kingdom of God. When Pope Pius XI instituted the feast of Christ the King in 1925, he called upon Christians to recognize only one King and one Kingdom: Christ and God’s Kingdom. To mature in our faith, we must clearly distinguish between the kingdom of man and the kingdom of God. The exercise of rights, the lay faithful’s participation in the public square and partisan politics must not be motivated by patronage and subservience to any political leader in the building of human and personal kingdoms, but in the building of God’s kingdom on earth.

God invites us to His Kingdom, not only as a future reward but as a present reality. Far from the kingdom of men that hinges on authority and power, God’s kingdom is a kingdom of harmony and love. We seek God’s kingdom by responding to Jesus’ message, by orienting our lives to the Gospel. The Gospel calls us to search for the ways so God’s presence will be witnessed in the world.

As believers, it is our mission to fully understand the richness and beauty of His Kingdom and be fully engaged in building this kingdom on earth. All our efforts for people empowerment, all our struggles for social justice find fullness and meaning when they lead us to the kingdom of God.

To make present the kingdom of God, political leadership must be a means to serve the people, especially the poor. Leaders must be measured by their sacrifices for the welfare of the people. Wealth and material resources are mere tools so each person may serve the other. All human capacities are shared for the good of the community so God’s will can prevail.

In human and personal kingdoms, society is ruled by selfishness, dishonesty, distrust, and enmities. In this kingdom, man hoards power and wields it unjustly, as we can see in our present context. The greed for power and wealth in the midst of abject poverty, the relentless pursuit for self-gratification, the exploitation of institutions and disrespect for law - they persist because man prefers to create his own kingdom; and followers of this kingdom fail to see that this kingdom is nothing compared to God’s kingdom.

When our sight is not set on seeking the Kingdom of God, all our labours are designed upon our own individual self-centered will. The marginalized will continue to be disadvantaged, the poor will only become poorer and the oppressed will never find justice.

When we hope for a better future, for a better society, we hope for the kingdom of God and to see God’s light shine through. To establish His Kingdom, we must fully engage in investing on moral treasure and not material treasure, in restoring a social order that respects the primacy of human dignity and in building the moral well-being of our country.

To continuously engage in building God’s kingdom, we must be equipped with love. We become open to sacrifice, to deny our selfishness and pride, to decide for common good, when we are motivated by love. The just ordering of society can only be possible when we are filled with love for God and for our brothers and sisters. “Love is rich in intelligence and intelligence is full of love.” (CV, 30)

CONCLUSION

God so loved each and every one of us that He put us in a community. He calls us to be His people not as individuals, without bond or link, but by making us into a single people – His family. Our membership in His family demands a sense of responsibility for each other as brothers and sisters. Our aspiration of a better life is meaningless if it does not include that of our brothers and sisters. We cannot call it a better life if we are blind to the poverty and injustice all around us. But in the same breath, we must not surrender to the poverty and injustice just because they are systemic and deeply entrenched in our society. There are many opportunities to conquer them.

The coming elections can be a fresh start in our hope for a better future. But as any opportunity, we must be prepared to embark on the journey despite our fears and limitations, trusting that God, the source of all good, will not forsake us.

In order for the election to mark a new beginning, we must accord it with sincerity and understanding that the change of leaders does not mean a change of systems. We may elect new leaders but it does not guarantee an end to the scams and corruption. We must hope for the right change so genuine transformation can take place.

We need to create and strengthen the middle class before we can witness genuine democracy. Empowerment of the people is best reflected by a vibrant middle class that will move the country towards social justice. Imbued with a social conscience, the middle class will champion the equitable distribution of wealth, lead the collapse of oligarchy and advance social justice. The quest for social justice finds true motive, inspiration and fulfilment in building God’s kingdom on earth.

People empowerment and social justice is not a work of one man, or even one administration. It is the work of one people – the people of God – that are in different human institutions and sectors of society: in the family, the Church, the schools, the business sector and government.

By our baptism, we have been tasked a prophetic role: to see, judge and act. We must be vigilant at all times. We need to see and understand the long-standing suffering of our people. We must make judgments, not only opinions. We need to discern and identify the evil that has caused our society to continuously suffer. Finally, we must make a move.

We need to denounce the evil by making the kingdom of God present in our lives and in our institutions.

A keen understanding of the causes of our misery and a conviction to rise above it will equip us as we bring about the transformation that we truly need and deserve as a Filipino nation.

In Mary’s Magnificat, Ina echoes God’s promise of His Kingdom. It is a Kingdom where the poor are no longer powerless. It is a Kingdom where: “He has cast down the mighty from their thrones and has lifted up the lowly.” (Luke 1:52) Her Magnificat moves us to be a constituency of the kingdom of God and not of the kingdom of man.

THE MAGUINDANAO MASSACRE: EVIL BEYOND ABOMINATION

BEYOND EVIL! In Maguindanao last November 23, 2009, a group on its way to COMELEC to file for candidacy in the 2010 elections was waylaid and ambushed, resulting in the brutal death of at least 57 people, many of them journalists and innocent civilians.

BEYOND BARBARIC! The murders were made even more abominable by the cruel acts inflicted upon the victims. Aside from suffering multiple gunshot and stab wounds, the breasts of the women victims were found to have been mutilated and their genitals riddled with bullet wounds.

BEYOND DESPICABLE! The crime committed is beyond heinous and is an abhorrent and brazen violation of the dignity of the human person! It has no place in human society! It loudly calls for the vehement condemnation by all -- Christians and non-Christians alike!

BENEATH CONTEMPT! The brutal murders done in the context of electoral politics seriously endanger our democracy and gravely threaten our democratic institutions! The insultingly insensitive and grossly irresponsible statement by no less than the Spokesperson of the President of the Philippines that the Palace – by reason of friendship - will remain supportive of the alleged perpetrators yet again demonstrate arrogance in Office and raises the specter of either complacency or connivance.L The use of Martial Law by the Highest Office as its way of response once more demonstrates its callous disregard for fundamental rights and utter lack of respect for the rule of law.

The training was undertaken with the support of ADMU School of Government-Pugadlawin Project. The trainers included Michelle Avelino of ADMU, Mr. Ramon Beleno of the ADNU Social Sciences Department, and Mr. Renne Gumba of the ADNU Institute of Politics. The participants were selected faculty, personnel, and students of the ADNU (and some representatives from the ADNU partner communities).

Statement on the Maguindanao Massacre

Vote for Peace 2010, a movement working for a political environment conducive to the conduct of a free, fair and peaceful elections, joins the Filipino people and the international community in condemning the senseless and gruesome mass killing of 57 innocent and defenseless civilians in the municipality of Ampatuan, Maguindanao province. Facts can be told about the incident but no words can exactly give description to the mass killings, what is clear is that the beastly carnage is a crime against humanity; an attack against press freedom and electoral democracy
Vote for Peace 2010 calls for the immediate arrests of all the principals and accessories to the crime, expedite the investigation and immediately prosecute the perpetrators so that justice to the victims be served:
 While Datu Unsay Mayor Andal Ampatuan Jr. is already under the custody of police authority, we strongly criticized the government’s manner of negotiating with his family to turn him over instead of immediately arresting him. Thus, we strongly demand from the authorities that Maguindanao Governor Andal Ampatuan Sr. and ARMM Governor Zaldy Ampatuan should also be arrested immediately by being themselves suspects of the crime.
 Others involved in the carnage should be pursued to the hilt. The officers and men of the PNP and AFP directly accountable to the breakdown of peace and order in the province should be suspended, relieved from their posts and investigated.
 A Total Gun Ban should be implemented in the province. All civilian armed groups, whether private armed groups, civilian volunteer organizations and CAFGUS should be immediately dissolved and disarmed.
 The CVOs and CAFGUs directly identified and working with the Ampatuans should be confined and investigated.
 The State of Emergency declared for Maguindanao should be put under Comelec control and its assigned deputies for peace and order.
The 23rd of November 2009 will be long remembered not only as the worst outbreak of election violence in this country in memory but also the scale of the massacre and its sheer brutality. It is the most brutal manifestation of warlordism; a monstrous act against electoral democracy, and the worst loss of life in the history of journalism, ever. On this day, 57 people, mostly women of which two were pregnant were mercilessly killed. Thirty of the dead were journalists. The victims were bullet-riddled in the heads and private parts; a number of bodies were mutilated and a number of women-victims manifest signs of physical abuse. While a number of bodies were scattered that showed they were strafed to their sudden death, most were found piled one after another in hastily dug mass graves. There were also bodies inside the vehilces excavated from the mass grave. The fate of the victims this day was simply decided by the senseless scheme of the Ampatuans to thwart the victims’ convoy that passed Ampatuan town on their way to file the Certificate of Candidacy of Buluan Vice Mayor Esmael Mangudadatu for the governorship of Maguindanao. This was taken as a viled threat by the Ampatuans that ruled the province like their personal fiefdom since 2001.
The Maguindanao Massacre sums up the spate of political killings across the country in recent years. These clearly show the government’s inutility in the securing, if not total disregard, to the rule of law and human rights. The Arroyo administration can’t keep away its hands bloodied from the Maguindanao Massacre. In the first place, warlordism in Maguindanao once more became strong due to the nepotistic coddling to the Ampatuans.
The Maguindanao Massacre, on the other hand, is a martyrdom of the victims in their pursuit of electoral democracy and press freedom. The victims knew the dangerous route they will go through, (though they never, nor anyone expected the barbaric act of such scale and horror) yet they pursued what they believe is the right thing to do. We are full of anger, shame and indignation for what befell the victims. But for their act, we should also act, so that their death will not be in vain.

We should be more steadfast and vigilant than ever as we draw close to the 2010 elections. We should work with all citizens and election stakeholders for the strict enforcement of election and peace and order laws. Let us educate ourselves with the election offenses defined by the Constitution and the Omnibus Election Code and be vigilant against the abuses and opportunism of the government and candidates. Let us be aware, and help our countrymen understand that election violence is a consequence of too much partisan divide among voters; vote-buying and selling; patronage politics; proliferation of loose firearms and private armed groups; and election campaign overspending. We should call the AFP, PNP and NBI to strictly enforce the Total Gun Ban; regulating the security escorts of candidates and disarm and dismantle all private armed groups and militias. We should call on the COMELEC to declare early the critical election hotspot areas so that preventive measures against incidents of election violence be done.

This is an abhorrent violation of the dignity of the human person! The crime is beyond heinous! Such act will never be acceptable to human society and must be vehemently condemned by both the Christian and non-Christian citizens of the world!

Indeed, politicians are scampering for cover. After all, the most important thing at the moment is not anymore what (or how much)they receive today. Its about securing a place (and a hold to power) in the future.

James O’Brien SJ Library, Ateneo de Naga University, Naga City, Philippines.

I sincerely believe that this activity will not only be a significant tool for political education, but also an opportunity to facilitate more vibrant political discussion in the locality. The various events that will be conducted aims to develop deeper understanding of the Philippine socio-politico-economic realities, and of expanding the appreciation of social democracy in the Philippine context.

I DID NOT KNOW HER PERSONALLY, BUT…

I did not know her personally. But I was fortunate enough to be around already when the 1st People Power took place. And I am sure then and now that I cannot distinguish one from the other: Cory led the People Power, and the People Power revolved around Cory’s courage.

She had demonstrated for us the type of leadership that strives for acceptance and legitimacy among the people.

Instead of relying on coercion usually enforced by armed groups, and manipulation observed in many patronage networks, she stood firmly and worked quietly for the restoration and strengthening of democracy and its institutions.

Instead of polarizing the armed forces, she pushed for social justice and empowerment.

Instead of manipulating government agencies for political gains, she implemented reforms in the bureaucracy.

Instead of endangering the electoral system, she gladly relinquished leadership to the next President.

I did not know her personally. But I will draw inspiration from her works and deeds. And at this point, I am sure many Filipinos are doing the same. Thus in her death, as in her life, she had awaken among us a sense of solidarity and pride for being Filipinos, Christians, and Catholics.

It is so easy to fall into the trappings of our everyday routine, and forget the fact that what we do (or do not do) ultimately defines the future that we create.

It is easy to say: “It is far away, why bother?” only to realize later on that we suffer the consequences of inaction, with our fellow Filipinos.

It is easy to babble about Philippine democracy as a concept, but difficult to realize that it is also a historical reality born out of the difficulties and sacrifices of earlier generations and must be consequently sustained and guarded by the present and future generations.

I did not know her personally. But she has touched my life not only as the leader of the country, but as a human being who struggles and grapples with the same everyday concerns of Filipinos. As a scholar, an activist, a widowed parent, and a woman, the various aspects of her life is a witnessing of her faith, fortitude, and courage.

To my mind CORY symbolized courage and strength that is not born from aggression and intimidation! She had shown us the kind of determination and unwavering commitment that comes from the heart and from the soul!

She also lived a life anchored on peace and non-violence, driven by the conviction that the path to unity and development is solidarity and respect for human dignity.

Most importantly, she has demonstrated that dignity, honor, and noble ideals are worth fighting for. In essence, her life has been a living testimony to the famous ideal espoused by her husband Ninoy: “The Filipino is worth dying for!”

I did not know her personally. But I will always remember her with fondness and gratitude.

Thank you Cory. (And Thank you Ninoy.)

In your life and in your death, (both of) you fought for the Filipinos in your unique, persistent, enduring ways.

I have never felt prouder about my being Pinoy, as I do right now!

The member-consumers of the CAMARINES SUR 2 ELECTRIC COOPERATIVE (CASURECO 2) have been hearing and reading media reports about the brewing trouble in the electric cooperative. The management is having problems about positions and jurisdictions. The workers are having problems with their payrolls and compensation. Legal cases were filed by the affected parties in various courts, including the National Electrification Administration.

It will only be a matter of time before ordinary consumers like us are affected by this predicament of the electric cooperative. Along this line, the Metro Naga Consumers Group in partnership with other socio-civic organizations decided to pursue a bold initiative aimed at providing a venue for the articulation of consumers perceptions, sentiments, and recommendations. In this forum, we hope to:

1. Provide a venue for member-consumers to protect and assert their rights over the conduct and governance of the electric cooperative;

2. Provide a venue for CONSUMER-ORIENTED discussion of the issues and problems hounding CASURECO 2;

3. Provide a venue for generating consensus on consumer interventions and actions towards CASURECO 2.

Bombs!

I was shocked when I saw the news yesterday about the bombing in the perimeter of the cathedral in Cotabato City. It killed five persons and wounded at least fifty others! As I have pointed out in previous blog entries, this act is becoming frequent and a pattern is emerging: the explosions are designed to sow terror among the public.

The military is quick to blame the MILF and its so-called “special operations group”, which the latter denied. In this situation, who is telling the truth, whom should the people believe? This query seems to b e the logical consequence of the unfolding events.

But a dimension that must be explored with equal interest is the question of the impact and consequences of such events. A patterned, systematic bombing gives the impression that there is an organized group capable of launching a national terror campaign. Further, it polarizes the country: the suspected bombers as the bad guys who must be chased down and the military as the good guys who must get these terrorists all cost. At the same time, it legitimizes the use of police powers by the state to protect public interest.

In any other context, this will be a widely acceptable move. But in a situation wherein democratic institutions’ legitimacy are quite low, these events tickle peoples imagination! One is reminded of the circumstances used by former President Marcos in declaring martial law then. Is it a strategy being employed by adventurist armed groups today?

Whatever is the emerging agenda in these bombings, violence is to be condemned and abhorred. Not only because it diminish the person’s dignity but also because it always hurts beyond the physical aspect. Violence is a total violation of the person.
Thus, as we condemn these bombings killing innocent persons we will also readily condemn any group who intends to use these events to legitimize further violence!

The CASURECO 2 Predicament

The Metro Naga Consumer Group endorsed and supported the entry of Mons. Nono Sanado into the cooperative’s Board of Directors as a final gesture for fostering transparency and accountability to consumers by the coop management and workers. His entry was not easy, made more difficult by the political and economic interests at play in the electric cooperative. Fortunately, Mons. Sanado got the support of the majority of the Directors.

UNFORTUNATELY, the road to transparency and accountability is not an easy one. Legal and administrative cases have to be filed and refuted. Internal and external hindrances have to be confronted. Even sectors within the cooperative eventually ended up fighting each other, further deepening the factions within the organization.

As the cooperative reels from these difficulties, the central question remains: WHAT IS THE ROLE OF THE CONSUMERS? Some would say they are mere product purchasers with no actual influence in the management, production, and service delivery. Others say the consumers are merely individuals/corporate entities buying electricity from the cooperative. Others would assert that the consumers are the actual owners of the cooperative, although technically marginalized by the present set up!

If you are an individual consumer like me, you end up wondering about concrete experiences with the cooperative:

YOU ARE ASKED/REQUIRED TO:
a. pay membership fee
b. vote for Directors of the Cooperative
c. encouraged to attend the General Assembly as the highest policy making body of the cooperative

BUT YOU EXPERIENCE THAT:
a. you do not get any benefit from THAT membership aside from actually being allowed to purchase electricity
b. NEA (a government agency) directly supervises the cooperatives, with the BoD as an inferior entity
c. the cooperative is a corporation wherein the personnel remits their social security payments like private corporations do

This dilemmas actually run smack into some issues which the electric cooperative must be able to resolve: (1)Is it a cooperative or a corporation? (2)Is it owned by the members, by the government, or private individuals/corporations? These questions must be confronted by the consumers, particularly because the electric cooperatives are instruments for the delivery of a basic service industry: power.

I am convinced that the policy environment among electric cooperatives is ripe for adventurism among various political and economic interests, leaving the organization vulnerable to exploitation and manipulation.

May we therefore ask the consumers to take a stand: Do we claim ownership of our electric cooperative? Do we simply leave it open to various players dipping their fingers into the power industry?

Worst fear getting real!

I have always expressed apprehension over the tight schedule which COMELEC is working with as it tries to implement poll automation. Unfortunately, such apprehensions are slowly getting confirmed! A major hitch in the process is encountered by the “falling out” between the local and foreign partners of the consortium that won the bidding process.

I have also expressed the fear that if elections will not be credible, this will hasten the deterioration of our democratic institutions, encouraging adventurism among elements of the left and of the right. Indeed, we are now getting reports about coup d’etat and bombs planted and/or exploding in government offices.

This is not a very comforting scenario. I am convinced that vigilant citizens must start making the move, bonding towards a more decisive mobilization for the protection of our fragile democracy.

We will never bow down to authoritarianism. Nor will we be silenced by intimidation and coercion!

2010 Jitters

As the election day draws nearer, those who are actively monitoring the preparations cannot help but feel some degree of apprehension. Are we going to be successfull in our poll automation efforts? Will election-related violence be avoided? Most importantly, will the entire process reflect the collective will of the majority

I have often heard people complaining about the blatantly outrageous overspending by some politicians on their propaganda machinery. Indeed, it has reached a scandalous level, even if these potential candidate are allegedly using their own private funds.

If money will continue to be the main factor , instead of competence and development programs/visions, in the electoral exercise perhaps we should introduce a radical change in the 1987 Philippine Constitution. Let us remove the provisions on elections. Instead, let us set up all elective positions for auctions/biddings! Those who can offer the highest price, or perhaps give every voter the highest amount, will get the position! That way, we avoid the messy electoral exercise and drop all pretensions of democratic ideals. Let us talk business and do business.

But of course, very few will agree to charter change before 2010 (a fact which majority of the congressmen/women prefers to ignore). Thus my proposal may have to wait after this 2010 elections. so we are back to where we started:

What will the 2010 elections do to us? Will it restore the peoples’ faith in our democratic institutions? Will it empower the marginalized? Or will it bring to the surface and simply legitimize a new ruling elite?

RESOLUTION 1109 CONVENING CONSTITUENT ASSEMBLY

In the darkness of night of June 2, 2009 the House of Representatives worked overtime. The majority passed Resolution 1109 against the valiant efforts of the minority to prevent its passage. Against the will of the majority of Filipinos, they resolved to convene a constituent assembly. They demonstrated why the majority of the Filipinos distrust Congress, and why, if the Constitution must be changed, they prefer a Constitutional Convention after 2010. In their resolution 1109, they betrayed the teeming masses they represent for the scheming machinations of Malacañang. We call on these congressmen and -women to return to representing their constituents and their consciences.

DO NOT BETRAY THE PEOPLE!

The House of Representatives, by resolving to convene itself into Constituent Assembly and to initiate charter change at this point, opens a Pandora’s box! Once convened, the Constituent Assembly may take up any agenda and make decisions, even without the consent of the people! Through the hurried passage of HR 1109, they initiated the move to amend the Constitution in a manner that lacks respect for and recognition of the duly established legal process. They junked the Senate. They betrayed the Constitution they vowed to protect and preserve. They manifested an utter disregard for genuine representation. They ceased to be our delegates, our trustees, and our representatives. Through such unprincipled action they have arrogated to themselves the authority that they are Constitutionally mandated to share with the Senate. They are not interested in reason, discussion, deliberation. They are interested in constitutional change through a sleight of hand, an intellectual chimera, a flawed argument, to strengthen the hold on power of the person in Malacanang, and to prevent any deliberation in the light.

DO NOT PLAY WITH FIRE!

Our country is imperiled by an economic situation that fails to respond to the driving poverty of our people, unmitigated corruption, declining trust and confidence in political leaders and institutions! A charter change process before the 2010 elections, that keeps charter change hostage to the interests of Malacañang, is dangerously divisive; it will fuel further adventurism among armed groups from the left and the right, and will awaken angry political action among large groups that have been content so far to be quiet. That quiet may be replaced by a willingness to fight and die in conscience for the good of the nation.

DO NOT PROVOKE TROUBLE!

In the spirit of strengthening our democratic institutions and retaining the fragile national unity that we are trying so hard to sustain, we strongly call on them to desist from pursuing Charter Change through a Constituent Assembly!

BAGUIO CITY, Philippines -- President Gloria Macapagal-Arroyo’s allies
in the House of Representatives said they would convene a constituent
assembly to amend the Constitution without the Senate when Congress
reopens in July despite outrage by religious and civil society groups.

Baguio Representative Mauricio Domogan, one of the authors of House
Resolution 1109, which calls for a constituent assembly, said the
House would start the Charter change process upon the resumption of
Congress sessions in July by “inviting everyone” to form the
constituent assembly, including senators.

Domogan said the assembly would proceed even if senators refused to
cooperate and they would only stop if the high court stepped in to
rule on HR 1109’s constitutionality.

“We want the court to settle once and for all how to interpret the
provisions guiding Charter amendments so that the next Congress won’t
have to argue should they move to invoke this mode of amending the
Constitution,” Domogan said.

Domogan said on Sunday that administration lawmakers were aware that
they were taking a calculated risk in approving the measure before
adjourning the 14th session of Congress last week.

Nueva Ecija Representative Rodolfo Antonino said that the House
leadership was considering sending HR 1109 to individual senators, and
not the Senate as a body, for endorsement.

Antonino said that this would serve as an invitation to attend the
constituent assembly.

He said the constituent assembly would be convened a few weeks before
the President’s State of the Nation Address on July 27 in order to
create a “justiceable” cause for the Supreme Court to lay down a final
ruling on how should a constituent assembly be formed.

He said lawmakers were hoping that public outrage would provoke a
challenge in the Supreme Court on the House position that amendments
to the Constitution could be approved by three-fourths of the entire
membership of the two chambers voting jointly.

The 23-member Senate has opposed the move, but Arroyo allies expect to
overcome the upper chamber’s resistance with their sheer number in the
lower house.

House Majority Leader Arthur Defensor Sr. said: “I don’t believe the
House will convene without the Senate or at least majority of them
must signify their intention to attend.”

Otherwise, the Iloilo lawmaker said, this would put the House in bad
light.

Defensor said the call to convene a constituent assembly would be made
by Speaker Prospero Nograles, “but he will have to first get a
consensus of all leaders before making a declaration.”

A pastoral statement issued over the weekend by Jaro Archbishop Angel
Lagdameo, president of the Catholic Bishops’ Conference of the
Philippines, urged peaceful protests against HR 1109, but Domogan said
the Church action was “premature.”

“The final judge would be the Filipino people in a plebiscite that
[would] ratify whatever proposals that would be approved [by a
constituent assembly],” Domogan told reporters in Baguio.

Referring to criticism that Charter change was meant to prolong the
term of the President, which is will end next year, Domogan pointed
out that HR 1109 did not seek the extension of term limits of elective
officials.

In Isabela, Cabinet Secretary Silvestre Bello III said Malacañang was
respecting the principle of separation of powers and would not meddle
in Congress’ moves to change the Constitution.

But Bello said lawmakers should explain to the public their decision
in passing HR 1109.

“The people have the right to know the reason behind their action,” he
said. “The public must have an open mind regarding this resolution.”

Lawyer Oliver Lozano and his daughter on Wednesday went to the Supreme
Court to challenge HR 1109.

Church threats won’t stop Cha-Cha, says Nograles

THE House leadership will not be deterred from amending the 1987
Constitution despite threats of mass protests from all sectors
especially the Catholic Church.

"Maybe we should remind them of the separation of Church and State,"
Speaker Prospero Nograles said yesterday.

In a pastoral statement Saturday, CBCP president archbishop Angel
Lagdameo called on those opposing Charter Change "to go on with their
plan of mobilization to protect the common good and national
interest."

The Archbishop of Jaro, however, appealed to the public to "express it
in a peaceful nonviolent way in order that we may not fall into the
trap that will necessitate martial law again."

Nograles also took a pot shot at Planning Secretary Ralph Recto’s
warning that the decision of the House to approve the Constituent
Assembly resolution will jeopardize the economy.

"Well, it’s the job of the economic managers to take care of the
economy and it’s the job of Congress to pass bills and resolutions by
voting in public and transparent manner. Secretary Recto did not make
that statement when we were proposing and debating the issue on
constitutional change. Why is it only now that he is warning us?" he
said.

"If the NEDA thinks that this could cause more shocks on the economy,
it is also therefore correct that the reason why our economy has been
suffering from shocks since most of us can remember is because of this
Cha-Cha issue," Nograles said.

"We have to find the answer now because otherwise, this cycle of
debate whether to Cha-Cha or not to Cha-cha will continue to have its
effects on the economy," he said.

Senate minority leader Aquilino Pimentel said Nograles should not to
waste his time reaching out to senators to support a Senate-less Con-
Ass.

Sen. Francis Escudero said Nograles’ attempt to persuade senators
should be on the premise that the House cannot do it without the
Senate. "Without that commitment, it would be useless to talk," he
said.

Sen. Mar Roxas said he is convinced that the 23 senators who signed a
resolution last year expressing their opposition on Cha-Cha would not
change their mind.

Sen. Alan Peter Cayetano said he has always believed Malacañang has
plans B, C, D, E… and so on to stay in power. "It is not a move by
congressmen and women of palaka (Partido Lakas-Kampi) alone. It has
PGMA’s blessings."

He cautioned the move of the House to talk to senators one by one
"must be taken seriously. This may be mind conditioning. Maybe they
have already the support of some senators."

Press Secretary Cerge Remonde assured that President Arroyo is not
seeking any elective position after 2010.

Reports said Arroyo might run for Congress in 2010, which could
entitle her to election as prime minister if she wins and joins
Congress.

"Hearsay lang iyan. Wala namang ebidensya na tatakbo siya," Remonde

Statement of PANDAYAN on the Assassination of Kahanay Rene Peñas

June 8, 2009

PANDAYAN strongly condemns the violent and treacherous killing of Ka
Rene Peñas, 51 years old, the National Vice-President, Pambansang
Kilusan ng mga Samahang Magsasaka (PAKISAMA). PANDAYAN join other
groups to seek justice for our dear Kahanay, Ka Rene Peñas, and
express support and offer our prayers to his wife, Evangeline and his
children, Noland, Jerald, and Wopsyjenn.

Ka Rene was cowardly assassinated by unknown assailants last June 5,
2009, at around 11:00 PM while on his way to his farm in San Vicente,
Sumilao, Bukidnon, while riding a motorcycle with his two companions.
His two companions survived, but Ka Rene did not survive from the
eleven gunshot wounds.

How could an active non-violent advocate whose life was committed to
serving the landless and marginalized farmers killed in such a violent
manner?

As an active non-violent advocate, Ka Rene, in 1997, is one of the 28
farmers who held a hunger strike for agrarian reform. In 2007, he led
the 55 farmers for a 1,700- kilometer walk from Sumilao to Malacañang
for the government to cover the over 144-hectare ancestral land they
claim in Sumilao. In 2008, Ka Rene also led the Banasi farmers in
their 444-kilometer march from Bula to Malacañang, which successfully
reversed the adverse decision made by Malacañang. Ka Rene, once again,
became one of the figures leading hundreds of farmers pushing the
Philippine Congress for CARP Extension with Reform (CARPER).

Ka Rene’s efforts bore fruit as the Senate and the House of
Representatives start today, June 9, 2009, their bicameral discussion
of CARPER. We believe that he continues to witness the victory of the
farmers.

We shall continue to pay homage to Ka Rene by continuing his struggle
to attain an authentic agrarian reform. This is our highest tribute to
him and his family, and our greatest expression of gratitude for what
he has achieved as his contribution.

PAKISAMA Statement on the Assassination of Renato Penas,
National Vice-President,
Pambansang Kilusan ng mga Samahang Magsasaka

PAKISAMA condemns in strongest possible terms the dastardly and cowardly assassination of our leader, Renato Penas (51) last night, around 11 P.M., while on his motorcycle with two companions to his farm in San Vicente, Sumilao, Bukidnon.
While his companions survived, the assassins made sure Ka Rene would not. Crawling after the first volley of fire, he was shot again, and three shotgun bullets fatally pierced his chest and back.

Who could have caused the death of a man whose life was dedicated to serving the landless farmers?

A participant in a 1997 28-day hunger strike for land and a practicioner of active non-violence, Ka Rene rose to be one of the most prominent PAKISAMA leaders over the past two years. As a trained community organizer-paralegal , he led in 2007, the unprecedented but successful 1,700- kilometer walk of 55 farmers from Sumilao to Malacanang to make their claim over a 144-hectare ancestral land covered by the CARP. He figured in 2008 as the organizer-trainer of the successful 444-kilometer Banasi farmers walk from Bula to Malacanang, which reversed earlier adverse decision of Malacanang. During the past two months, Ka Rene was leading farmer groups coming from different persuasions, in a coalition campaign to push Congress to enact the extension and reform of CARP ( CARPER).

On May 30, he went home and was jubilant to learn that CARPER was finally passed by both houses of Congress and would soon be passed into law. But he was not given the opportunity by his assailants to see the fruit of his work.

We demand a speedy and objective investigation of this case. We ask the Arroyo government to demonstrate dispatch and professionalism in solving this crime.
We mourn with the widow and four orphans of Ka Rene and demand an end to the culture of impunity pervading in our society. We pray that Ka Rene would be the last among our leaders to be assassinated. We hope his case would not suffer the fate of two of our colleagues. On November 22, 2009, two hooded men gunned down our former Vice-President for Mindanao Vic Paglinawan in Davao City. On March 9, 2009, Boy Billames, Secretary-General of SAMATIKU, a member-farmer federation in South Cotabato was also gunned down by a hooded assassin. Until now, no suspects have been identified and caught in both crimes.

We call on the Filipino farmers to close ranks and transform to inspiration and courage the martyrdom of our leaders.

Let us continue the fight for agrarian reform and good governance and politics until every farmer owns the land s/he tills, until every citizen is not harmed while peacefully claiming his or her rights.

MANILA, Philippines – Debates dragged for hours but it took only a few
seconds for the House of Representatives to approve a resolution that
would convene Congress into a constituent assembly to amend the 1987
Constitution.

With the “ayes” registering a louder vote than the “nays,” the House
of Representatives late Tuesday approved House Resolution 1109
convening Congress into a constituent assembly to amend the 1987
Constitution.

Even as all the interpellators have yet to speak, Shariff Kabunsuan
with Cotabato City Representative Didagen Dilangalen made a motion to
stop the interpellation period and go on voting. This was immediately
seconded and approved.

Members of the minority registered their objection.

Nueva Vizcaya Representative Carlos Padilla said the country witnessed
a "simple tyranny of the majority" and called the chamber "the worst
Congress in the annals of Philippine history."

“I believe in democracy, but this tyranny,” South Cotabato
Representative Darlene Antonino-Custodio said.

"Have we no shame? Let us stop this farce immediately," Bukidnon
Representative Teofisto Guingona III said.

“We oppose this, this charade… Let us amend the Constitution after the
term of President Arroyo. That is the time to amend the Constitution
of the Philippines. The best way to amend the Constitution is by
constitutional convention,” said former Speaker and Pangasinan
Representative Jose de Venecia Jr.

With the passage Nueva Ecija Representative Eduardo Nonato Joson
likened the country to a woman fighting off a rapist, saying “Huwag po
kuya [Please don’t, sir].”

“Let us not gang rape our Constitution,” he said.

Bayan Muna party list Representative Teodoro Casiño said one of the
sponsors of the resolution had admitted on the floor that the "whereas
clause" in the resolution that prohibits the term extension of the
incumbent president and vice president, senators, congressmen, mayors
and other elected officials whose term will expire in 2010, and that
there would be elections in 2010 was "not binding."

Gabriela partylist Representative Liza Maza asked one of the sponsors,
Cavite Representative Elpidio Barzaga Jr., it was possible under the
resolution to postpone the 2010 elections.

"Everything is possible, but it depends on the sound judgment of our
colleagues," Barzaga said.

La Union Representative Victor Ortega also echoed the same view,
saying that they would rely on "trust" basis in implementing the
“whereas clause.”

Parañaque Representative Roilo Golez said the majority pledged to have
an exhaustive discussion in plenary of the resolution.

"If we cannot trust them [majority] on this very small pledge, how can
the people trust the members of this Congress as constituent
assembly," Golez said.

Representative Luz Ilagan of Gabriela party list called the
proceedings a "night of ignominy" where the administration allies once
again used their numbers to push their agenda.

Quezon Representative Lorenzo Tañada III said he voted against the
resolution because Congress does not need to pass one in its use of
its inherent legislative powers. He added he is also against the
"crass" manifestation that the House alone can act in amending the
Constituion without engaging the Senate.

Proponents of the measure are in quandary if the House can convene as
an assembly on its own. Several lawmakers, including those form the
majority bloc, said that the Senate should be part of the process of
the constituent assembly.

“It always takes two to dance the Cha cha,” Cebu Representative Pablo
Garcia said during the earlier part of the debates.

By his interpretation, Garcia said HR 1109 was “just an invitation to
both Houses to convene in order to propose amendments to or revise the
Constitution.”

La Union Representative Victor Ortega, chairman of the committee on
constitutional amendments, echoed that the Senate could not be ignored
in the process of convening a constituent assembly.

Camarines Sur Representative Luis Villafuerte said he drafted the
resolution, but Speaker Prospero Nograles was its main author.

Villafuerte had withdrawn his signature to the resolution, saying that
there was no more time to rewrite the Constitution with barely a year
to go before the May 2010 elections.

“I have withdrawn my signature and I’m not supporting this resolution
anymore,” Vilalfuerte said, noting that “there’s a group in the
majority that’s undermining the resolution they are sponsoring.”

Minority Leader Ronaldo Zamora questioned the haste with which it was
being discussed in plenary, with only two session days left and with
other key legislation pending for passage.

“Why the short cut? Why not go for the long haul, for the harder
route? Why not eschew the easy path and make the amendments to the
Constitution as important as the role of the committee on
constitutional amendments?” Zamora said.

In the resolution, it was interpreted that voting should be done upon
the three-fourths of “all the members of Congress, not three-fourths
of each House voting separately.”

Proponents of this measure had hoped that this would prompt someone to
question it before the Supreme Court, so that the tribunal could
decide whether voting by the two chambers of Congress should be done
jointly or separately.

“So what is the point of all of this, if there is no justiciable
controversy… if you agree with me that the Senate is part of the
process?” Zamora said.

Proponents of the measure are still in quandary if the House can
convene as an assembly on its own. Several lawmakers, including those
form the majority bloc, said that the Senate should be part of the
process of the constituent assembly.

Earlier in the day, administration allies vowed to use their numbers
to have HR 1109 approved on Tuesday’s session and will study the
option if the House could convene into a constituent assembly even
without the Senate.

Interviewed after presiding over a caucus of the majority, Nograles
said the bloc would pass HR 1109 and then study their next moves.

“After we pass it we will have to study our next moves, study, legal
(study),” he said.

Taking up the constituent assembly resolution was one of the
agreements within the merged Lakas-Kampi-CMD party, despite the
withdrawal of support of Villafuerte, who recently resigned as Kampi
president.

President Gloria Macapagal-Arroyo is aware of the plan of the
congressmen, the Speaker said.

“Of course, I will not deny that the President just listened, she did
not say anything, bahala kayo [It’s up to you],” he added.

The constituent assembly resolution was approved in an emergency
meeting of the committee on constitutional amendments Monday so it
could be referred to the rules committee for floor deliberation
Tuesday.

Nograles said HR 1109 would be taken up first before House Resolution
737, which seeks specific amendments to the economic provisions of the
Constitution, because it only needed the vote by a majority while the
latter resolution required three-fourths vote of all members of
Congress since it was introducing specific amendments.

As to the Comprehensive Agrarian Reform Program (CARP) extension,
Nograles acknowledged that the pressure was now on the House after the
Senate passed it on third reading Monday night.

He said the House just received a copy of the 78-page document and was
still studying it.

“The options are basically two: first, is the easier option to adopt
their version and it’s finished. The second is to make another version
and go on bicam [bicameral committee meetings] over the holidays,”
Nograles said.

TASK FORCE 2010 is a consortium and partnership between and among various election watchdogs aiming to push for the needed reforms in the electoral process and even in the COMELEC in order to restore credibility to the whole exercise and to ensure that there will be a clean, honest, peaceful, and credible elections in 2010 and beyond.

TF2010 gives priority to ensuring that the following vulnerable sectors of our society are given utmost attention in the exercise of their sovereign electoral rights: (1)detainees, (2)first time voters/youth, (3)elderly, (4)indigenous people, (5)internally displaced persons, (6)differently-abled persons, and (7)migrant workers.

There is a growing clamor among civil society leaders to take back politics from the control of politicians and bring it back as an instrument for governance and development. As a start, there were initial discussions of a partisan involvement in the 2010 elections. An emerging initiative is the Change Politics Movement (CPM) which aims to rally its members around a criteria and process for selecting candidates which they will eventually support and campaign for. Initially, the following criteria serves as a basis of unity for those joining the CPM:

AVOIDING PITFALLS

In drawing up the criteria for selecting a presidential candidate, we would like to avoid the following pitfalls:

• “All-or-nothing” approach in viewing candidates’ commitment /responses to our desired principles and practices
• Inordinate sectoral/localized bias to the neglect of broader, cross-cutting, national agenda
• Formulation of principles/practices in broad “motherhood” terms that fail to provide concrete basis by which to assess prospective candidates’ capacities to assume the country’s highest public position

FRAMEWORK IN FORMULATING/ORGANIZING CRITERIA FOR SELECTING CPM’S PRESIDENTIAL CANDIDATE

The basis for to assessing and eventually selecting CPM’s presidential candidate shall consist of three categories:

1. Integrity and Track Record

By their past actions and choices, we shall know them. Presidential aspirants don’t come to our attention in a vacuum or with a clean slate. Whether in public or private roles, they have made choices, championed causes (or not), selected the company they move in, steered their career (and family) in certain directions. We cannot and should not rely just on promises for future action. By their past, they have given us a strong indication of how they will run the country and where they will take it. Thus, our first category of criteria is Integrity and Track Record.

2. Immediate, Strategic Agenda to Stop the Slide and Restore the Philippines in the Track of Democratic Reform and Good Governance

The next President has the difficult task of leading the country out of what is arguably its darkest period in recent history. The next President needs to have a firm sense of how s/he will pull the country out of its current morass and restore it in the direction of Democratic Reform and Good Governance in a period of extreme challenges confronting the entire globe. Without abandoning our specific sectoral agenda, we need to be able to push for the next President to boldly undertake a strategic national agenda which will address immediate, lynchpin issues and problems necessary to reverse the grievous impact of the past years of mis-governance and abuse and, thus, allow the space and momentum to build towards sustainable reform and development outcomes. Thus, our second criteria-category is the candidates’ proposed Immediate, Strategic Agenda for the presidency.

3. Capacity to Win Power for Reform

For a candidate’s good track record to be put behind and realize his/her bold reform agenda, however, the candidate will have to win the elections. S/he will have to be able to seriously engage in a national electoral contest for the highest position in the land. Thus, our third category is the Capacity to Engage in National Electoral Contest – the Capacity to Win Power for Reform.

CHECK-LIST ON CRITERIA FOR PRESIDENTIAL CANDIDATE (PC)

1. Integrity and Track Record

1.1 Character and Credibility
• Has the PC held positions requiring public trust and credibility?
• Has the PC been implicated in corruption or grave public scandal? What about the PC’s family members or close associates?
• What is the reputation of the people who are most closely associated with the PC?
• Has the PC been transparent in his/her transactions, whether in public office or in a private capacity?
• Has the PC ever been caught lying, cheating, stealing or applying double-standards in public or private transactions?
• Can we trust the PC to do what s/he says and to give us the real picture on the problems facing the country?
• What is the PC’s track record in human rights, including respect for women and children within his/her immediate circle of association?
• Has the PC demonstrated a love of country and value for the common good above the interests of one’s family or close associates?

1.2 Competence

• What positions has the PC held up to now? Have these positions provided sufficient experience and preparation to run an entire country?
• Has the PC had dealings of any sort with the bureaucracy? With what result?
• How about the PC’s dealings with public agencies? The private sector? The NGOs? The basic sectors or people’s organizations? Did s/he promote meaningful participation of these sectors in his/her previous positions in government or in the private sector?
• What has been the PC’s experience in bringing about multi-sectoral discourse and consensus?
• Has the PC had any experience in foreign policy? Has s/he had experience in dealing with the security sector?
• What is the PC’s background in economics and/or finance?

1.3 Leadership and Politics

• If the PC has previously been engaged in politics, what has been the PC’s party record? Is s/he a good party person, respecting and strengthening change politics practice within the party?
• Has the PC’s family or close associates ever taken advantage of the PC’s position of power or authority, whether in public service, the private sector, or civil society?
• Has the PC faced important crisis situations? How did the PC fare? Was s/he able to take the lead and inspire others to face and overcome the crisis?
• Does the PC have a constituency base among the basic sectors, including minority and marginalized groups? Is his/her relationship with the constituency empowering or patronage-based?
• Has the PC been able to inspire and mobilize citizens to correct a particular injustice in his/her area of responsibility?

1.4 Position Taken on Issues

• What position, if any, did the PC take on the following issues, especially within the last 3-5 years?

Political Reform (especially Electoral Reform and Decentralization/Local Autonomy)
Good Governance (especially Anti-Corruption, Anti-Presidential Abuse of Power)

Fiscal Reform

Asset Reform (specifically, Agrarian Reform, Urban Land Reform, Fisheries and Aquatic Reform, and Ancestral Domain Rights)

Environment and Sustainable Agriculture (especially Mining and Sustainable Farming Practices)

Human Rights (specifically, the issue of Extra-Judicial Killings and Martial Law –like Abuses by the military and the police)

• Aside from the list above, what other issues has the PC championed? What have been the hallmarks of the PC’s public advocacy in the course of his/her career or voluntary engagement?

2 Immediate, Strategic Agenda for the Presidency

Considering the current dismal state of Philippine democracy and governance, the following are the strategic, lynchpin issues which the next President should address. We will therefore ask the PC how s/he intends to address the following agenda within his/her “first 100 days,” without requiring any new legislation or constitutional revisions/amendments:

2.1 To immediately stop the plunder of public coffers (e.g., How will the PC handle GMA, her family and cohorts?)

2.2 To rebuild and strengthen democratic institutions (e.g., What is the PC’s plan with regard constitutional bodies? What is the PC’s proffered policy on presidential appointments? How will the PC restore checks-and-balance within the executive and across the three branches of government? How will s/he balance respect for the autonomy of the LGUs and ensuring their compliance with national laws/priorities esp. on asset reform, people’s participation and anti-corruption.? How does s/he view civil society/basic sector participation in established governance bodies, especially NAPC, Presidential Agrarian Reform Commission (PARC), National Commission on IPs (NCIP) and the local development councils?)

2.3 To raise sufficient resources and ensure proper allocation and spending of public resources for priority programs (e.g., What is the PC’s plan for raising public revenues and what are the priority programs on which public resources will be allocated? How will s/he ensure transparency and accountability in the management of the national budget?)

2.4 To raise productivity (especially in the rural areas) and ensure fair distribution of assets of production, benefits and public funds (e.g., What is the PC’s plan for raising national productivity, especially in the countryside? How will the PC ensure that the costs and benefits of development will be justly shared? How will s/he push asset reform in his/her “1st 100 days”, specifically distribution of CARPED landholdings, delineation of municipal waters, issuance of Certified Ancestral Domain Titles, the proclamation of urban lands for the urban poor?)

2.5 To ensure social protection for the poorest and most marginalized sectors and communities (e.g., What is the PC’s proposed program to protect the poorest and weakest from the onslaught of the global economic recession? Where will the funds come from and how will s/he make sure that the programs reach the intended beneficiaries?)

2.6 To set the foundation for restoring the peace track with armed parties (e.g., Does the PC have a plan with regard the government peace panels and OPAPP? What about the reports of the UN Human Rights Rapporteur, the Melo Commission, and the Commission on Human Rights?)

3 Capacity to Win Power for Reform

Objective measures will be used to assess the PC’s capacity to seriously engage in the electoral contest for the highest position in the country which will be held within one year of the launching of CPM. These measures will include looking at the PC’s –

• Level of public recognition on a national scale
• Actual and potential extent of support constituency
• Access to or capacity to raise needed funds
• Actual presence of organized support and machinery in different parts of the country
• Alliances with other political forces

STATEMENT ON THE ARREST OF JUN LOZADA

We, the Former Senior Government Officials (FSGO), condemn in the strongest terms the arrest of Engineer Rodolfo “Jun” Lozada, over flimsy and concocted perjury charges filed by PNR General Manager Michael T. Defensor against him. His arrest stands in stark contrast to the freedom and impunity enjoyed by such allies of the current regime accused of far greater offenses -- Jocelyn “Joc-joc” Bolante, Benjamin Abalos, Romulo Neri, Hernando B. Perez, Virgilio Garcillano, Jesus Martinez, Eliseo dela Paz, and others of similar notoriety.

The minions of the current regime find it all too easy to persecute to the fullest all those who expose its abuses, and oppose its corruption and bad governance. Whistleblowers are harassed and hounded, even as obvious prevaricators and practitioners of corruption are protected, promoted, and highly rewarded. What kind of message do we thus send to our people -- that good is punished and evil rewarded?
How have we as a people come to this state of things?

We call on Mike Defensor to stop posturing as if he is the aggrieved person, even as he was clearly a participant in the cover-up of what became an aborted abduction of Jun Lozada. What moral values does he hope to impart to his young children with his vain and obstinate defense of injured pride, while participating in the cover-up of gross abuses against our people and our laws?

Jun Lozada’s persecution demonstrates how truth has been sacrificed at the altar of immoderate greed. We enjoin all sectors of our society to protest Lozada’s incarceration in the strongest terms, and show to the world that we are not helpless in fighting for our rights and freedoms, that we have not, as a people, surrendered to evil.

We, the leaders of Kaya Natin! A National Movement for Good Governance and Ethical Leadership lament the arrest of NBN-ZTE Star Witness Rodolfo "Jun" Lozada. It is very disheartening to see that the person who risked his and his family's life to tell the truth about this controversial government transaction is now being branded as a liar. More disheartening is the fact that those who perpetuated this said anomalous transaction has not been held accountable for their actions thus, denying the Filipino people the justice that it deserves. These actions send the Filipino people a wrong message when it comes to the impartiality of our present justice system. This will also discourage other future whistleblowers from coming out in the public to expose other corrupt practices present in our current government.

As a movement composed of well-meaning government leaders, we believe that good governance in our country will only be achieved if those who perpetuate graft and corruption practices in our government be held accountable for their actions. Thus, we call on the Ombudsman to act swiftly and with impartiality in prosecuting those who have taken part in this said scandal.

We continue to extend our support to Jun Lozada in his quest for the Truth and in his fight against graft and corruption in our government.

VOTERS EDUCATION AND SATELLITE REGISTRATION FOR THE YOUTH AND FIRST TIME VOTERS

Since the Catholic Educational Association of the Philippines (CEAP), Parish
Pastoral Council for Responsible Voting(PPCRV), and the National Movement
for Free Elections (NAMFREL) entered into a Memorandum of
Agreement(MOA) with the Comission on Elections(COMELEC) to help attain honest, peaceful, and meaningful 2010 elections, several activities were already undertaken jointly or separately by these institutions.

One of the activities identified in the MOA is the campaign to educate and encourage the registration of the youth, particularly those who will be voting for the first time. Thus, in Bicol Region, the Ateneo de Naga University hosted a VOTERS EDUCATION AND SATELLITE REGISTRATION FOR THE YOUTH AND FIRST TIME VOTERS last Friday, 13 March 2009 at the Xavier Hall, Ateneo de Naga University.

In the 10am - 12nn forum, the resource speakers Comissioner Leonardo Leonida of the COMELEC and Mr. Lito Bunag of the PPCRV Special Projects Office provided inputs for the guidance and encouragement of first time voters.

In the satellite registration conducted by COMELEC from 8am - 5pm, at least 150 first time voters from Naga City were allowed to register as regular voters.

The activity also served to jumpstart the campaign for the holistic formation of students towards active and responsible citizenship thru participation in the 2010 elections.

Ehem! Anticorruption Workshop in Iriga City

The Ateneo de Naga University Institute of Politics conducted with the Coalition for Bicol Development(CBD) and the Local Governent Unit of Iriga City the Ehem! Anticorruption Workshop last Feb. 20-21, 1009 at the Masosu Spring Resort. The IP Executive Director Mr. Renne Gumba was the main resource speaker and facilitator of the two-day workshop attended by non-government and peoples organizations (NG0s and POs) of Iriga City. Ehem! is a training manual produced by the Jesuits in the Philippines, intended primarily to enhance personal commitment to combatting corruption. Since its publication, Ehem! trainings have been conducted for government agencies, private and even religious organizations in the local and national level.

Schools to mobilize for 2010

Citizens participation in the electoral exercise is hardly a walk in the park. For instance, it is projected that for the 2010 elections, PPCRV and NAMFREL will need at least 500,0000 volunteers from all over the country to do the tasks of voters education, pollwatching, and quick count.

That is why I was so glad when I learned that educational institutions are mobilizing on a national scale for the 2010 elections. The COCOPEA and CEAP have inked a memorandum of agreement with the COMELEC, PPCRV, and NAMFREL.

Among others, the agreement intends to help ensure a clean and credible registered voters list; and to conduct voters education nationwide to encourage registration among first time voters. This is will be pursued in the spirit of collaboration in the following areas: (1)promotion of voters registration, (2)voters education, and (3)recruitment and deployment of volunteers.

Aside from ensuring a reliable pool of trained volunteers for citizens participation in the 2010 elections, this initiative will encourage a more coordinated and systematic learning experience among students of various schools and universities toward active citizenship.

The wonders of technology!

I have witnessed its potential in transforming our electoral culture as early as 2003 when Ateneo de Naga University run several demonstrations of the software “Botong Pinoy”, a fully-automated voting system developed by Mega Computers.

You register as a voter by being physically present and having your identity determined through biometrics, characteristics which are spectacularly unique to each individual. This will include fingerprint, retina of the eyes, etc. This process is supposed to purge the voters list of “flying voters” intentionally doing multiple registration in several localities, and even those who pose as someone else registering several times under different identities.

In the election day itself, wonders of the touch screen technology with the voter simply touching the colored picture of the candidate he/she is voting for. And at the end of the voting process, he/she just confirms the choices entered and receives a print out similar to those issued by ATM machines, confirming the accuracy of the votes noted by the machine.

Most important, the vote you cast immediately gets counted and it takes less than a day to count total votes and determine the winners!
How excited I was then of the transformation it will cause the country’s electoral process!

But after two national elections and the 2010 elections drawing nearer, I am growing to be a lot more wary of the government’s ability and sincerity in pursuing modernization of our elections!

First, it(the national government) had chosen to invest millions of pesos in the purchase of counting machines which ended up rusting in some warehouse.

Second, it has refused to fast track the modernization law then, taking it up only when the 2007 election day was a stone’s throw away.

Third, it has failed to initiate the computerization process early enough and thus ended up panicking over such pursuit before the 2010 elections. I wonder if the COMELEC will have the ability and time needed to bid out, purchase, install the computer network nationwide, and train its personnel nationwide for the computerized elections.

But let us keep our fingers crossed.

If it doesn’t happen, we have always been known for being a patient and tolerant people anyway. Much as we may desire to push the government to work harder and faster, it seems we cannot! Much as we may desire to shame those who scheme to get elected into position, it seems we cannot! Worse, much as we may desire to act together and work for the common good, it seems we cannot!

But even if we cannot, its a wonder we still keep our fingers crossed...

politics - we can't live without it!

Politics refers to any persistent pattern in human relations which involves to a significant extent power, influence, or authority.

As such, our daily life is a political experience. The act of convincing our kids to pursue a university course, the process of deciding wheteher to go out with our friends or not, the decision to desist from harming others even if we are so pissed off. All these, and a lot more, are political affairs.

But many social scientists would be largely preoccupied with institutions and processes, particularly on the macro level. Thus governance and electoral politics would be at the center of everyone's consciousness whenever politics is brought up in a discussion.

Unfortunately, this only laid down the foundation for people to believe that politics is bad and to be avoided-even if to their mind, it is clear that electoral politics and governance issues are the major concerns.

An equally unfortunate consequence of this situation is when people and institutions start to announce: we dont want to have anything to do with politics! we are not a political organization! One doesnt have to be an expert to discern the message: indifference and apathy to politics is beneficial.

But we are not supposed to forget the fact that politics will always have both a personal dimension and a social dimension. Thus even those institutions who are supposed to cater to the individual person, and his/her soul, are actually doing something political.

So can we really do away with politics? Maybe not. It is deeply embedded in our actions and emotions, both on the personal and collective level. And can we afford to be indifferent to politics? Maybe not. Because there is so much at stake!

The year 2009 may be described in terms of the plans and preoccupation of the people. In the Philippine social context, the 2010 elections, economic difficulties, corruption, and the drive for charter change are among the prominent issues that will be in the limelight.

A look into these issues in terms of the actors involved brought to mind an interesting theme: shapin' up, holdin' on. On one hand, a group of people is quite busy preparing for an electoral exercise. On the other hand is a group of people dreading the approach of the exercise and their descent to oblivion.

The year 2009, it seems, will be a year for hardworking individuals and organizations. Those who want to grab power and those who want to stay in power.

(A Statement Issued by the Hunger Striking Farmers and Bishops)

The hunger striking farmers and bishops are united in their analysis and rejection of the joint resolution being proposed by the House of Representatives and the Senate. The farmers and bishops are not swayed by this palliative measure which contravenes the Constitution and does not respond to the call of the farmers.

The said resolution supposedly resolves to maintain "the status quo" on the implementation of the Comprehensive Agrarian Reform Law as "its effectiveness extends until June 30, 2009". Setting an expiration date for the CARL is contrary to the constitutional mandate on the continuous implementation of the agrarian reform program until all agricultural lands in the country are covered and distributed to the landless farmers. Neither a resolution nor a law can terminate a program mandated by the Constitution. The Joint Resolution shows the pale resolve of our legislators to perform their mandate. It clearly exposes that the vested interests of the landed in government take precedence over the Constitution and the welfare of the farmers and over national accord.

While the Joint Resolution seeks to extend the implementation of land acquisition and distribution, it does not provide any funds for agrarian reform implementation aside from what is provided in the proposed 2009 National Budget. Without the Agrarian Reform Fund (ARF), the GAA budget is too limited even for a minimal acquisition and distribution of land under CARP. The farmers and bishops demand a more definite decision of extending financial support for CARP and institutionalizing needed reforms which are provided in HB 4077 and SB 2666.

It is ironic how the legislators complain about defective program implementation when the effective implementation of CARP had been historically blocked by interests of influential landowners, among who are members of Congress. The legislators cannot repeatedly ignore the command of the people and the law. They should not be allowed to feign blamelessness and claim non-accountability. Had they willed to do so, the legislators could have studied and incorporated the amendments proposed by the farmers during the past six months. They already bought time the last instance they proposed a similar resolution in June. As expected, such bogus measure resulted in the cessation of all land acquisition and distribution processes as the Department of Agrarian Reform could not boldly implement the very core of this supposed centerpiece program of the government.

What makes this second attempt different from the previous one such that it will suddenly ensure that the DAR will continue fulfilling its duty? The only difference is that this time things are worse as some legislators contemptuously insist on striking down compulsory acquisition without which the program will be at the mercy of landowner volunteerism. As such, CARP would be rendered virtually futile. The very reason for the need to reinforce CARP is the recalcitrance of owners of big landholdings—mostly families of powerful public officials- and the lack of support services to fuel agricultural production.

How could the legislators claim that they need material time to "study and generate consensus on appropriate amendments" and at the same time insist on eliminating the most critical components of the program? Do the legislators think they can convince the farmers that this resolution is being proposed to better the program and not to facilitate its termination? Do the legislators think the bishops cannot perceive that this measure is nothing but a quick fix meant to mislead? The Joint resolution is obviously being devised to merely placate the hunger strikers who demand accountability from the legislators who failed to take decisive action on the CARP extension with reforms in the last six months.

The farmers are convinced that the consensus the legislators contemplate is obviously that which will be acceptable to the landowners' bloc. The bishops discern that what is lacking in this situation is not material time but compelling resolve. And such resolve will not ferment in six months or a year. Such consensus ought not to be the consideration; it is the farmers' predicament which is of concern. In the final analysis, what is inevitable and what would surpass all this filibustering is the imperative of responding to the farmers who feed our nation, fulfilling the constitutional fiat and the policy behind agrarian reform. For the hunger strikers, the problem is not lack of material time but the acute lack of political will and resolve from the country's political leadership to ensure the compliance to the Constitutional mandate of pursuing agrarian reform until its completion.

The agrarian reform program was enshrined in the Constitution to address poverty and promote food security. It is a revolutionary and comprehensive measure which caters to the poor and will never see fulfillment unless the implementers of the law are forced to will themselves to submit to it. The legislators have been given sufficient time to respond and yet we find ourselves at this standstill yet again. It is high time to rouse them to action, to give them reason to accede to the imposition of law and national conscience.

WE, the Coalition for a Citizens’ Constitution(C4CC), a national coalition composed of at least 3,000 non-government and peoples organizations implementing programs for and working with the basic sectors all over the country;

DEEPLY CONCERNED about the escalation of violence and war between the government and MILF forces in Central Mindanao due to the collapse of the peace talks after the aborted signing of the Memorandum on Agreement on Ancestral Domain (MOA-AD) killing scores and pushing half a million innocent civilians into evacuation centers deprived of food and other basic services;

WORRIED that the current efforts in Congress to speedily convene itself into a Constituent Assembly to revise the 1987 Constitution even without the Senate’s concurrence would result to self-serving changes such as the consolidation of power of the President and existing government officials and the extension of their respective terms in office;

UNDERSTANDING that fears for a Martial Law declaration also to extend the term of Mrs. GMA may not be totally unfounded given the current strong influence of Mrs. GMA in Congress and the Supreme Court and the increasing number of possible justifications for such as the raging war in Mindanao and the potential economic recession and depression;

AWARE that these worsening political and economic crises besetting the country are happening amidst the lingering legitimacy issue and fight for political survival and relevance of Mrs. GMA;

The YOUTH FORUM ON CHARTER CHANGE will be conducted 1-5pm on Saturday, 18

The Mindanao Situation and Charter Change

I. Background

A.The BANGSAMORO struggle

The situation in Mindanao is a complex experience of economic, political, and demographic factors flowing into a social context of cultural and ethnic diversity. Professor Randy David aptly describe the situation when he did an article on the Mindanao situation using sociological concepts: “The Bangsamoro problem is entangled in so many historical, legal, cultural and political questions that it is irresponsible to talk about it in a simplistic way. Every attempt to capture the issues in a single frame is bound to inflame passions and exacerbate prejudices. Reason demands that we step back and attempt to sort out the issues.”

To further understand the emergence of this situation in Mindanao, Archbishop Orlando Quevedo, OMI of the Archdiocese of Cotabato outlined the historical developments which lead to the present realities in Mindanao: (1.)Islam arrived in the Philippines 200 years before Christianity arrived. Eventually and before the Spaniards came a regime of sultans began. From that time on the Bangsamoro people have asserted and exercised self-determination and sovereignty over their ancestral domain, until the effective political power of the sultanates faded away. The Bangsamoro people came under the control of the Americans. The ancestral domain of the Bangsamoro people became public domain. (2.) But even when the Americans gave independence to the Philippine, many of the Bangsamoro people continued government. Successive waves of migrants from the Visayas and Luzon in the 1900s, authorized by a series of public laws, gained land titles in the form of torrens titles as against the native titles of the Bangsamoro people. (3.)The population pattern in Mindanao significantly changed from the 1920s to the 1960s. In the 1930s the great majority of Mindanao people were Muslims and Indigenous Peoples (IP), with a small minority of Christians. By the time the waves of migrations ended in the 1960s, Christians constituted the great majority of Minadanao people, with a minority of Muslims and IPs. In other words the Bangsamoro bacame a minority in their own ancestral domain. Difference in concepts regarding land ownership also contributed to these major changes in the ancestral Bangsamoro ancestral domain.

It is within this historical context and contemporary social complex that the Bangsamoro people sought to regain their ancestral domain. In the proposed MOA-AD, Bangsamoro refer to “those who are natives or original inhabitants of Mindanao and its adjacent islands including Palawan and the Sulu archipelago at the time of conquest or colonization and their descendants whether mixed or full native blood.” Spouses and descendants, including the Lumads (indigenous peoples), under the agreement, are also classified as Bangsamoro “unless they choose otherwise.” They are the ‘First Nation’ with defined territory and with a system of government having entered into treaties of amity and commerce with foreign nations,”

The struggle over ownership and control of the rich terrain of Mindanao continues. Such struggle has included both armed fighting and negotiating for sustainable peace.

B. The peace process in Mindanao

The prolonged armed conflict in Mindanao has been depicted in various ways: either as ideological/political war, religious war, ethnic/clan war, or even a combination of all. As a political war, it is sometimes viewed as the struggle to attain independence from colonizers including those from “Imperial Manila”. The conflict is sometimes also viewed as a battle between the Muslims and the Christian settlers who have driven them away from their land. There are also instances when the conflict is viewed as a war among competing clans vying for political spoils or vengeance. But the different perspectives simply underlined the persistent conflict in the island.

Given the persistent armed confrontations, several initiatives to attain peace have been undertaken, both in the domestic and international arena. To cite some, the Mindanao Peace Solidarity, an advocacy network of local government units, non-government and peoples organization in Mindanao identified the following milestones in peace-building efforts: (1.) 1976 Tripoli Agreement – An agreement to create autonomous region in Mindanao, including 13 provinces and 9 cities as possible areas under the autonomous region. The creation of the Autnonomous Region will follow the Constitutional process. This agreement was signed on December 23, 1976 with the help of Libya and Organization of the Islamic Conference (OIC). (2.) 1996 GRP-MNLF agreement - It provided for the present Autonomous Region in Muslim Mindanao (ARMM) and its coverage area. It also created the transitory mechanisms (SPCPD and Consultative Council, SZOPAD) for development. The agreement was Signed in Manila on September 2, 1996 with the help of Indonesia and OIC. (3.)The GRP-MILF Peace Talk – The formal talks with MILF was initiated by former Sec. Ruben Torres in December 1997 upon instructions from Pres. FVR; followed by the signing of a truce between MILF-GRP. In 2000, Erap launched all-out war against MILF and openly insulted Muslims by roasting pigs in Camp Abubakar. In March 24, 2001, the Tripoli Peace Agreement was signed calling for a General Framework for the Resumption of Talks between GRP-MILF. In Feb-March 2003, PGMA launched an attack in the Buliok Complex, the new HQ of the MILF resulting to renewed hostilities.Truce was again declared and both GRP-MILF established the Joint Ceasefire Monitoring committee and calling for the establishment of the International Monitoring Team led by Malaysia.

It is within the latest GRP-MILF peace talk that the Memorandum of Agreement on Ancestral Domain (MOA-AD) was drafted and finalized. After almost twelve years of fighting, the document purports to recognize the aspirations of more that eight million Muslims and indigenous people of Mindanao.

C. The Memorandum of Agreement on Ancestral Domain (MOA-AD)

The MOA-AD is an agreement of the GRP-MILF signed last 27 July 2008 in Kuala Lumpur, Malaysia by Mohaqher Iqbal of the MILF negotiating panel and Mr. Rodolfo Garcia, head of the government negotiating panel and Secretary Hermogenes Esperon of the Office of the presidential Adviser on the Peace Process. The signing was witnessed by the Malaysian special adviser to the Prime Minister.

In general, the document aimed to to define/recognize/undertake the following: (1)defined the Bangsamor people, (2)outlined their territory and the resources therein, guided by the Bangsamoro claim on ancestral domain;(3)provided for the government structure and sovereignty; (4)laid out timeframe and conditions for the completion of a Comprehensive Compact, including the conduct of a plebiscite and eventual referendum. Many of the provisions in the agreement are premised on the introduction of changes to the 1987 Philippine Constitution and amendments to the Organic Act of Muslim Mindanao.

After the signing by both panels in Malaysia, and when the provisions of the agreement reached the public, there was immediate public uproar over the alleged secrecy. A case challenging the constitutionality of the agreement, and a petition for Temporary Restraining Order (TRO) which was eventually granted, was filed in the Supreme Court by local government officials from Mindanao and several national leaders including Senator Mar Roxas and former Senator Frank Drilon.

The issuance of the TRO, and the GMA administrations decision to abide by it, prompted outrage by some MILF leaders. This eventually led to the attach on several towns in Minadanao, to the continuing battle between the rebels and government forces, and to the displacement of thousands of families because of the continuing armed conflict. The situation has prompted Malacanang Palace to announce that it will be reviewing its decision to sign the MOA-AD.

II.Issues Involved

A.In the Mindanao Situation:

1. Perspectives on the Bangsamoro Struggle and the MOA-AD: paradigms, nation-building, constitutionality, and the peace process

The proposed MOA-AD attempted to steer the peace process towards the recognition of a fundamental element in the prolonged armed conflict: the Bangsamoro claim over their ancestral land. Technically, the document is upholding the Bangsamoro claim, even in a limited sense, over ancestral domain. But it must be noted that Mindanao at the moment is populated by the Christians, Muslims, and the indigenous peoples known as Lumads. These phenomenon is more often called the tri-people character of Mindanao. There are distinct differences in the paradigms or world view among these people, each group having their distinctive way of looking at realities around them. A classic case would be that on land ownership. The Christians would look at it in terms of land titles and the corresponding rights it gives to the owner. Muslims and the lumads however would rather look at it from the point of view of ancestral ownership. It is not surprising then that Christians would be up in arms against the perceived taking of what is “rightfully” theirs, as shown by land titles and several generations of their families having occupied the land. Nor will it be surprising that several lumad organizations are now coming out to speak against the proposed MOA-AD. They are claiming that if the Muslims can claim ancestral domain, so can the lumads. In fact, they were in the island long before Islam came into the territory.

Even as the MOA-AD predicament is uncertain because of public pronouncement of the Philippine government to review the decision to sign it, the document still deserved closer scrutiny. The impact and implications of the issues it triggered are too grave to be ignored. Whether it is a boon or bane will depend on whose talking and what perspective is used. For the Bangsamoro, the agreement would have signified a limited advancement in their struggle to regain ancestral domain. As cited by the U.P.-based Center for People Empowerment in Governance (CENPEG): “The MILF views the MOA as step forward for the Bangsamoro goal of self-determination. Its leaders can always invoke the general concepts and principles of the MOA-AD to pursue the MILF'S political goal more so if they choose to declare unilaterally a separate state later on.” But for others, the MOA signified an arrogance and abuse of discretion by the government negotiating panel. Atty Barry Guttieres pointed out: “What is bothersome about the current situation is that apparently the negotiations was conducted without recognizing the conditional nature of certain points contained in the agreement...And perhaps this is one point where the GRP panel can be called to task – for failing to adequately delimit the actual parameters of its authority to negotiate.”

The question of whether the agreement is constitutional or not would also have contending views. Senator Mar Roxas argued that it is unconstitutional: “This MoA initialed and sought to be formalized, in Malaysia, violates at least three major articles of our Constitution. Unang pahina pa lang, hindi na papasa ito sa ating Saligang Batas. Rather than respect our national territory, this MoA breaks it up into already smaller bits. Rather than uphold the ideal that all government authority emanates from the people, the government had the gall to enter into an agreement that would partition our country, and create a state within a state, all without prior consultation with the people of Mindanao, or with the people in the rest of the country. It had the gall to shroud this agreement in secrecy. Rather than uphold one sovereign people enjoying the equal protection of law, the MOA effectively splits the citizenry in two, each clothed with differing political and economic standards.” But Atty. Soliman Santos, a Bicolano human rights lawyer countered: 'To seek constitutional change and reform has not usually been treated as unconstitutional, except it seems when it has to do with the Moro question.” And Fr. Joaquin Bernas, S.J., a prominent constitutional expert clarified: “MOA is not a done deal: elaborate collection of “wish list” of those who want to revise the Organic Act of Muslim Mindanao and event the Constitution...But amendment proposals cannot be illegal and much less unconstitutional”

2. On the Peace Process

Thus the main issue now is what will bring lasting peace in Mindanao. Cotabato Archbishop Quevedo is convinced that the MOA-AD can lead to lasting peace: “But the MOA-AD, no matter how one looks at it, is a remarkable document. It is a very serious attempt to balance national sovereignty and Bangsamoro aspirations for self-determination and freedom. For this reason, I believe that the MOA-AD can bring lasting peace.” Unfortunately, Macanang Palace is now rethinking the decision to sign it because of the recent atrocities committed by renegade MILF troops.

Allegations of abuse and indiscretion against the government panel is starting to surface. Mr. Mon Casiple of the Institute for Political and Electoral Reforms observed:“Where did the President and her negotiators got their authority to promise what they cannot give?...If what they are thinking of doing is to change the 1987 Constitution in order to shift the Philippine state from its current unitary system to a federal state system with local states, then they are putting the cart before the horse. They should do this before negotiating on a federal framework for the peace process”.

With the current peace process being haunted by difficulties in the national political landscape, particularly the spectre of its being used to compel charter change and extend Arroyo's term, the tendency to rely on the military solution is expected from the government side. But several organizations have spoken openly against military solutions, and called for a broader dialogue. They argue that the other stakeholders must be involved in the peace process, going beyond the emphasis of peace process on the armed groups. Special attention must be given to the marginalized sectors, such as women and children who suffered most in the present situation.

Unfortunately, while no effective strategy is being adopted and no decisive action is undertaken, the number of civilians displaced by the on-going battle in several areas of Mindanao will continue to increase. The situation in Lanao del Norte, Maguindanao, Shariff Kabunsuan, North Cotabato , Sarangani, Basilan and other areas of conflict may turn out to be extremely serious humanitarian problem.

B. Charter Change

1. Federalism will bring lasting peace in Mindanao?

Many of the provisions in the MOA-AD will require changes in the 1987 Philippine Consitution to be viable and do-able. For example, the establishment of the BJE will entail a set up akin to federalism, wherein the Bangsamoro will be one state in a federal system. Thus, with the MO-AD being peddled as the blueprint for peace in Mindanao and charter change as the tool to implement that blueprint, the government was quick to play it up and push for federalism and charter change.

Unfortunately, many sectors felt that the situation is not right and the process is so hurried. Thus, instead of focusing on intelligent discourse on the impact of a political set up such as federalism to the persistent armed conflict in Mindanao, critical awareness, inherent caution and even paranoia prompted strong opposition to any discussion of charter change. Such public reaction effective exclude significant discussion on the viability of federalism as a solution to the persistent armed conflict in Mindanao.

It is thus unfortunate that intelligent discourse on alternatives and proposed structural changes in Mindanao is effectively hampered by political considerations.

2. When do we introduce changes in the 1987 Philippine Constitution?

Several provisions in the present Constitution have been identified for possible changes. Among these are the form of government and economic provisions. But as important as the substantial changes being proposed is the debate on the timing for initiating these changes.

There are several options being floated among those who seek structural reforms through charter change. Majority of the legislators seem to have attained consensus on the matter of transforming themselves into a constituent assembly to work immediately on the changes to be proposed in the 1987 Philippine Constitution, allegedly taking into consideration the urgency of the situation in Mindanao. In fact, there are pending bills in the Senate and in the House of Representatives proposing the immediate constitution of a constituent assembly.

But civil society organizations, religious groups, and even the business sector seem to agree on the position that charter change may be undertaken only after GMA is out of Malacanang Palace. From their point of view, it is imperative that discussions about changes in the Philippine Constitution be undertaken only at the right time and in the right situation. It must neither be used for political gains or for entrenching local elites. Charter change must be a tool for broader citizen participation and empowerment of the basic sectors of society.

3. If changes will be made, how will it be done?

Another persistent issue related to charter change is the mode of introducing change. Although the Constitution provides for three options, the more prominent options being considered are Constituent Assembly and Constitutional Convention. This is probably because of the difficulties encountered by those who previously attempted to initiate charter change through peoples initiative.

Constitutional Convention, though admittedly more costly, is more popular among the citizens because people get to elect their delegates to the body that will deliberate on the proposed changes. The other option, Constituent Assembly (which converts the Senate and House of Representatives into deliberative body for charter change), is less attractive because of the perceived political and partisan interests already displayed by congressmen and senators during their term.

III.Challenges

The situation in Mindanao and the resurgent move to introduce changes in the 1987 Philippine Constitution are two significant developments that must be understood, analyzed, and acted upon by the Filipinos. The predicament of our brothers and sisters in Mindanao (the lumads, Muslims, and Christians) must be understood from the informed perspective so that solutions and actions may be guided accordingly. It should also heighten the sense of solidarity with our fellow Filipinos in that island. The charter change initiative must be taken on and exposed for whatever it is: a sincere initiative for structural change and reform or an instrument for manipulation and political interest. Thus, the following challenges are posed to the university community:

1. The education we experience in the university is supposed to enlighten us with the truth and inform us of the actual social conditions. What do we know about the situation in Mindanao? How do we distinguish factual information from biases and stereotypes? Do we understand the charter change issues? What is our take on these issues? Do we have an appreciation of the impact of these issues to our lives as Bicolanos, as Catholics, as Filipinos?

2. Our knowledge and awareness is expected to condition our convictions and principles. Including our notion of what is right and what is wrong; what must be done and what must be discouraged. But most important is the shaping of our social conscience, when we go beyond vague generalizations and learn to train our sight on actual and empirical circumstances. Our paradigms and framework significantly affect how we perceive reality.

3. Most importantly, knowledge/awareness and convictions/principles should inform our action. It triggers a certain response from us. It leads us to ask: What have I done? or What will I do? The question increases in difficulty and complexity when elevated to the societal level. But the impetus to act will not go away. The need to actualize and live out or become witnesses of our principles and convictions will demand a certain response, whether as individuals, as a group, or as an institution.

Waging peace!

What makes peace so attractive? It is because everybody yearns for a condition of relative tranquility, wherein one is free to express oneself, and to pursue one's interest. What makes peace so elusive? It is because many would look for peace from the outside, without realizing that peace comes from within.

Anyway, I attended the 1st Naga City Peace and Order Summit today and the perspectives presented were as varied as the participants gathered in the said event. But what struck me most is the interest manifested by people who are not in the formal structures of the government.

It never cease to inspire me whenever I witness such enthusiasm for citizens participation in governance. It may not always cause miracles, but for me, the phenomenon of active citizenship by itself is extraordinary.

I only hope that the government, including all of its units/sub-units, would continue to sharpen their tools for openess to citizen participation. It will not take a single act to perfect the art, but with patience and perseverance, good things usually come out.

Thus waging peace is not only about catching criminals or silencing the guns. It is also about our growing up, as a people, in the respect for diversity and in the understanding of complexities.

May peace thrive in the heart of Naguenos.

Several reasons why I am supporting the bid of Msgr. Nono Sanado to become a member of the CASURECO 2 Board of Directors:

1. as a consumer, I feel the need for more significant participation of the member-consumers in the affairs of the cooperative. at the same time,it is so frustrating when I feel that the cooperative is not intent on opening itself up to significnt consumer intervention. thus, there is a need to install more leaders who are willing to open up the cooperative and engage the consumers as partners!

2. as a citizen/Nagueno, i believe that transparency and accountability is an imperative every elected leader must uphold. unfortunately, this is not always the case. citizens are then compelled to learn the art of lobying and social movements. groups and organizations are manifestations of collective sentiments. it is extremely important that agenda and interest can be articulated, not only by institutions and leaders, but by the citizens themselves.

3. as a Catholic, i am so proud of a clergyman who identifies with and works for the laity. the seed of solidarity that is sown, when social stratification and differentiation is partly obliterated by common aspirations, actually strengthens the church! the inspiration that is generated when a priest becomes a servant-leader goes beyond this generation. and it makes me proud to be a catholic!

"An Tama, Tama! An Sala, Sala!"

Mons. Nono Sanado is running unopposed. It seems he will be riding high into CASURECO 2 Board of Directors fuelled by the clamor for change and passion for involvement among consumers.

This early, the prelate intends to visit each barangay for a hectic consultation schedule with electric consumers. Such process will not only be campaign sorties but also the initial organizing work for barangad-based consumer groups. It is hoped that upon assumption to office, the prelate will maintain tight working collaboration with the consumer groups in his area of responsibility.

Thus the general call of Mons. Sanado: "An Tama, Tama! An Sala, Sala!" becomes a rallying point for improving the management and service-delivery of CASURECO 2 via greater participation and involvement of the member-consumers.

Consumers are then confronted by a three-pronged challenge: 1. organize themselves and get their acts together; 2. establish working relations with Mons. Sanado, particularly on policy directions to be pursued via the Board; and 3. go out and vote on August 30 as Mons. Sanado calls for more voter turn-out in the elections.

Its been a while since my last entry in this blog. A lot has happened since then. And a lot more is bound to happen soon.

At the moment, we have several interseting phenomenon in the socio-political arena. Mons. Nono Sanado, the parish priest of the Metropolitan Cathedral, is running for a slot in the CASURECO 2 Board of Directors, to represent the North District (at least 15 barangays in Naga City, including the Naga City Public Market).

The Metro Naga Consumer Group has engaged the prelate in their advocacy for wider consumer participation, more transparency and accountability, as well as meaningful reforms in the cooperative.

In the national scene, the Memorandum of Agreement on Ancestral Domain (MOA-AD) is turning out to be the GMA administrations latest justification for charter change. CHACHA and the MOA-AD is now being peddled as the solution to the peace problems in Minadanao.

In response, the Coalition for a Citizens Consititution (C4CC) has launched a capaign premised on the following: (1)affirm the struggle for self-determination of Moros as crucial element in the attainment of PEACE , (2)TANGO before CHACHA; GMA must be out of the picture before we talk about changes in the Philippine Constitution; (3)PEACE and CHACHA must be a truthful, transparent, and participatory process; (4)elections of CONCON delegates may be undertaken simultanoeously with the 2010 elections; (5)FEDERALISM must ensure greater resources and power to the citizens, not to local warlords.

The Camarines Sur NGO-PO Formation has also started consolidating its ranks. Several engagements are underway, particularly its membership to the Coalition for Bicol Development (CBD). CBD is a regional network affiliated with the CAUCUS OF DEVELOPMENT NGOS (CODE-NGO).

Of course, we cannot ignore the coming 2010 national elections. Presidentiables have been shuttling back and forth to Naga City. Aspirants for various positions in the local and national level are starting to make their presence felt in various ways. I even heard that campaign funds are strating to circulate this early.

I will discuss these concerns in my coming blog postings. For the moment, I just want to mention those highlights cited above. My blogspot is back.

I was in Tuguegarao City last 21-25 April 2008 for the Annual Conference of the World Bank-Knowldge for Development Center(KDC). Aside from the substance and proceedings of the conference itself, I was pleased to discover the warm reception by the people of Tuguegarao City specially that of the St. Paul University Philippines community led by its President, Sister Remy.

It was a truly revealing visit and an inspiring experience in hospitality for visitors. Thank you Sister Remy, Mam Jo, Mark, Joan, and all the people of St. Paul University Philippines and Tuguegarao City! Guidelines for Communal Discernment and Action
to Address the National Crisis

The Context

1. The ZTE-NBN controversy has once again raised questions about abuse of power and systemic corruption in the government of President Gloria Macapagal-Arroyo(GMA). This is just the most recent in a series of events that indicates a worrisome pattern of behavior in government, particularly of anomaly and cover-up, leading to the weakening of Philippine democratic institutions. Among these are the “Hello Garci” scandal, the fertilizer scam, the promulgation of calibrated preemptive response (CPR), EO 464 and PP 1017, the unresolved extrajudicial killings and disappearances of activists and media practitioners, the undermining of impeachment proceedings, the pursuit of self-serving charter change, and the lack of a decisive response by the government to the farmers of Sumilao, Bukidnon due to political compromises in the implementation of agrarian reform. Good governance and longterm reform are being sacrificed for short-term political survival.

2. Many Filipinos are outraged by this situation because of what appears to be a deliberate suppression of truth, and the refusal of the government to be made accountable. Many also feel confused and powerless, leading to a sense of hopelessness and deepening distrust of political leaders and institutions. There is a real danger that citizens will become disempowered and disengage themselves from politics. At the same time, there are also those whose frustrations have led them to join armed insurgent groups or are seriously considering insurrectionary and other unconstitutional options because of the inability of government to effectively address the issues of the poor and respond to the call for truth and accountability. Then there are some members of the economic and political elite, who out of pragmatic considerations, have adopted a “wait-and-see” position and have therefore not helped in providing clear leadership in terms of clarifying the issues and options.

These include the politicians who are potential presidential candidates in the 2010 elections.

3. While there is anger and despair because of what is happening to the country, there are also possibilities that have opened up with the recent events, for bringing about serious and much-needed changes in the political and governance institutions and culture of the country. How we respond as a people to this crisis will determine whether we can make the most of this opportunity for a renewal of Philippine democracy.

Diversity of Responses

4. Part of the reality of the present crisis is the diversity of views and even division among people, across and within sectors, in their analyses of and reactions to the situation. Therefore, it is important to note the range of political positions and options among those who have responded. This range represents a continuum, that allows a capture of the essential differences across groups, while at the same time recognizing that there are real overlaps among the positions and those who represent them.

a. “The economy is good. Let’s move on.” The Arroyo government and its
allies insist on projecting a picture of a growing economy, on the one hand,
which is undermined by unnecessary and debilitating “political noise,” on the
other hand, created by “partisan” groups whose only agenda is to unseat the
President. This type of politics is seen as bad, not just for economic growth,
but also for addressing the poverty problem because it is the poor who are
most affected by political instability. Therefore in this view, the country must
move on, since it argues that the administration has a mandate to rule until
2010. Likewise, there are those who may not explicitly support GMA, but
believe that given the alternatives, the President represents the lesser evil.
Effectively, they do not support any moves to hold the government
accountable.

b. “All politicians are corrupt. Let’s focus on jobs, services and the poor.”
Some business associations, socio-civic organizations and faith-based groups
are highly cynical of national politics or have given up on it altogether, and
thus do not see it as the avenue for meaningful change. They concentrate on
what they see as the more important tasks of job-creation and servicedelivery
(e.g., housing, health, education). They believe that what they are
doing has more long-term impact because they address the more basic issues
of poverty and hopelessness, which breed corruption and a culture of
dependence.

c. “Let the 2010 elections resolve the crisis.” Strict rule-of-law advocates hold that President Arroyo legitimately won the 2004 elections, even if there are serious and impeachable questions of cheating. They believe in accountability through constitutional mechanisms like an independent factfinding commission, impeachment and ultimately elections. In this perspective, there is no doubt that the search for truth must be pursued, even as they believe that the crisis can only be eventually and truly resolved through the electoral exercise scheduled for 2010.

d. “Bring out the truth, hold GMA accountable, and work for reform.”
There are faith-based and civil society organizations that call for “truth,
accountability and reform,” emphasizing concrete measures like resolving the
issue of executive privilege, calling for an independent counsel (with
investigative and prosecutorial powers), pushing for possible impeachment,
and advocating long-term reforms pertaining to freedom of information and
transparency, electoral and civil service reform, and social justice (especially
agrarian reform). These initiatives are meant to provide constructive ways for
people to participate in meaningful democratic governance and institutionbuilding.

e. “No real reform is possible under GMA.” There are prominent concerned
individuals and groups who also adopt a truth-accountability-and-reform framework, but are more emphatic that a precondition for genuine long-term
reform is holding President Arroyo directly accountable for the undermining
of institutions. Thus, they would tend to be more explicit in taking a
principled position that the government should step down, and that a
succession should hew as much as possible to the Constitution.

f. “Oust GMA.” Various groups from both the Left and the Right of the
political spectrum, many of them not sharing a long-term agenda, are
tactically coming together on the objective of ousting the Arroyo
government, even through extra-constitutional means. This may take the
form of an EDSA-like people power, military withdrawal of support, a
Cabinet coup, or some combination thereof. They are not in agreement on
who or what should assume power in the aftermath of an Arroyo ouster.
Some may accept Vice President Noli de Castro taking over, while others
prefer special elections (on the premise that the Vice President will also step
down or be made to do so) or “snap elections” or an interim civilian-military
junta that will put key reforms in place and oversee a return to constitutional
government. It is important to note that groups on the Left recognize the
need for bringing in more long-term structural reform, beyond merely
replacing the President.

Non-negotiable Principles

5. Given these and other options that may be taken, it is important to identify some non-negotiables, for more thoughtful and responsible communal discernment and action:

a. Uphold the truth. Truth, especially regarding cases of graft and corruption,
cannot be sacrificed in the name of stability. Stability that is the product of
unresolved issues tends to be shallow and short-lived, as the credibility and
capacity of institutions designated to pursue the truth are weakened, and
other cases of corruption surface again and again. Moreover, this situation
contributes to the reinforcement of a culture of impunity.

b. Exact accountability. Government must be held accountable by the
people, for all its actions and decisions, in all policy areas, and at every point
of its stay in power. This means that the exacting of accountability should
not take place only at the time of elections because democracy cannot be
confined to the single act of casting a vote, but is a continuing process of
citizen participation. Nevertheless, elections are also a core mechanism of
accountability, especially since the present political crisis is linked to
unresolved questions of electoral cheating. Part of the response necessary at
this time involves the rebuilding of public trust and confidence in
institutional mechanisms of accountability.

c. Pursue meaningful reforms. Even in situations of crisis, efforts at electoral,
bureaucratic, and social reform should not cease because many of the country’s problems are really of a structural and institutional nature, needing
continuing transformation. There is a need to recognize the problems and
propose concrete solutions.

d. Build and strengthen democratic institutions. The country needs to
establish and fortify democratic institutions, which provide consistent,
organized and self-regulating procedures, applied to all citizens equally.
Among these institutions are due process, civilian supremacy, rule of law,
checks and balances. While Philippine democracy is still flawed, the genuine
gains that came with the dismantling of the Marcos dictatorship and the
restoration of democratic institutions should not be lost. The alternatives
(e.g. a military junta, a civilian-military authoritarian regime, a communist
government) are even more unstable, unpredictable, unsustainable, and
potentially harmful. A second democratic breakdown, moreover, will be
much more difficult to undo. Strong democratic institutions can likewise help
address the present conditions of real divisions among Filipinos. By
providing agreed-upon rules and mechanisms which are accepted as credible
and fair, institutions facilitate the peaceful resolution of conflicts among
dissenting positions and approaches.

e. Promote responsible and engaged citizenship. Moral outrage in the
present moment is called for, and is critical for a committed response; but it
must also lead to a serious and responsible consideration of consequences
for the medium and long term. Hopefully, such a responsible and engaged
citizenship will lead to the transformation of the present culture of one-sided
dependency on leaders. The country’s problems have been reinforced by
generations of patronage that have led Filipinos to depend disproportionately
on those who have more resources and more power, in politics and society at
large, in the Church, and even in the ordinary barrio or baranggay.

f. Champion active nonviolence and protect human rights. Action is to be
guided by principles of active nonviolence. “Violence is evil… violence is
unacceptable as a solution to problems…. Violence destroys what it claims to
defend: the dignity, the life, the freedom of human beings” (Compendium of the Social Doctrine of the Church, 496). Human and civil rights must always be respected and promoted (Centesimus Annus, 22). Any coercive means is unacceptable, including forms of harassment, detention without due process, and policies that seriously undermine the freedom of the press and the right to self-expression and organization.

g. Prioritize the poor. The real and urgent concerns of the poor should be
given highest priority amidst all efforts to search for the truth and promote
accountability. If many Filipinos seem to be uninvolved or uninterested, it is
primarily because of an overriding concern for economic survival during very
hard times. Indeed, the search for the truth is integrally linked to the fate of
the poor. Corruption and dishonesty have made the lot of the poor worse.
Programs and initiatives from both government and the private sector to
address poverty and inequality, and to respond to the urgent needs of the poor, in fields such as education, health, housing, livelihood and the
environment should continue to be supported, and indeed intensified.

h. Engage and involve the youth. It is important that all activities should seek
to involve the youth, and harness their energies, especially for truly
sustainable reforms and institution-building. Significantly, recent events have
awakened many young Filipinos and stirred them to become more politically
involved. Today, there is an opportunity to do political education and
mobilization of the youth on a scale not seen for many years.

Analysis of Options

6. Given these guiding non-negotiable principles,the different positions and options presented above can now be reviewed, in order to help build common ground and move towards a consensus on how best to respond to the ZTE-NBN scandal and the broader political crisis:

“There is no problem with GMA.”
a. Business as usual, status quo. Not holding government accountable in any
way is unacceptable. “Political authority is accountable to the people….
Those who govern have the obligation to answer to the governed”
(Compendium, 408, 409). The nature of the allegations of corruption in this
particular case is so serious, that any government with some sense of
responsibility to its citizens cannot but respond, to work towards establishing
the truth beyond any major question or doubt, and so confirm its legitimacy.
“Political corruption… betrays both moral principles and the norms of social
justice.” (Compendium, 411) Moreover, there is much truth to the view that
fighting corruption is not against the economy. Indeed, corruption is antidevelopment
and anti-poor.

“GMA is not the main problem.”
b. Give up on politics. Among those who hold this position include a range
that spans from the exhausted, to the cynical, to the apathetic. All of them
move towards a position that views all politicians as being equally selfinterested.
Effectively, none of them focuses on GMA as the problem. Such
a view that disengages from all politics and does not identify concrete points
of action and reform only contributes to the sense of hopelessness and
paralysis. At all times, participation in the social and political realms, either as
individuals or as members of organizations, is a duty to be fulfilled with
responsibility and with a view to the common good (Compendium, 189).

c. Focus on the delivery of services to the grassroots. The preferential
option for the poor necessitates a long-term perspective on development beyond mere regime change. It also makes the delivery of services to the
grassroots essential, regardless of who is in power. Thus, those who have
opted to concentrate on this course of action are to be commended.
However, while citizen-involvement in particular areas of social development
and local politics is a form of participation, they will always be constrained by
large-scale anomalies and abuse of power on the national political level. All
citizens must work towards the eradication of the evils of patronage politics
and national political corruption, in order to promote the common good.
“How does one address the GMA problem?”

d. Call on GMA to resign. There are individuals and groups who have been
calling for President Arroyo’s resignation since 2005 and continue to hold
that position as a matter of principle. At that time, the CBCP itself
recognized the call for the President’s resignation, as well as for a “Truth
Commission” and impeachment, as legitimate options under the guiding
principles of accountability, constitutionality, non-violence and effective
governance. While the bishops did not call on President Arroyo to step
down, they asked her to discern “to what extent she might have contributed
to the erosion of effective governance and whether the erosion is so severe
as to be irreversible.” Therefore, those who in conscience have made a
decision that the President should not remain in office deserve respect. Their
call for her to resign voluntarily is one of the options provided for in the
Constitution. However, it also needs to be pointed out that while this
position is one of principled moral conviction, it ceases to be a real political
option if GMA remains resolute that she will not resign voluntarily.

e. Cabinet declaration of incapacity of the President. The Constitution
provides that a majority of Cabinet members can declare in writing to the
Senate President and the House Speaker that “the President is unable to
discharge the powers and duties of his [her] office” (Article VII, Section 11).
This is a constitutional way of removing a President who is seen to be
physically or mentally incapacitated, but the meaning of this provision may
be interpreted more broadly. This is one scenario for an “internal or Palace
coup” within the GMA regime. But such decisions on regime change tend to
be elitist, as they are dependent on so few people. This declaration can be
challenged, however, by the President, in which case Congress may confirm
the Cabinet decision by a two-thirds vote of the two houses of Congress
voting separately. Note that this requirement is even more stringent than the
one-third percentage required for the House of Representatives to send an
impeachment complaint to the Senate for trial.

f. Oust GMA. When faced with the President’s refusal to resign voluntarily,
those who are willing to push the demand for her to step down to the point
of employing even extra-constitutional means must be reminded that
democratic institutions may be harmed in the long-term, especially if a political vacuum is created for groups with an anti-democratic, adventurist or
power-grabbing agenda to try to seize power and hold on to it indefinitely.

g. People Power. People power is a precious legacy from the struggle against
the dictatorship and the restoration of democracy in the Philippines. EDSA I
was the culmination of a long process of political education, organization and
mobilization throughout the martial law years and especially during the nearly
three years after the assassination of former Senator Benigno Aquino. Active
nonviolence was a defining characteristic of EDSA People Power. It is
enshrined in the Constitution, which values initiatives from below as a way of
harnessing the direct participation of the people in politics and governance.
In its current usage, however, it is problematic because it is often equated
with popular insurrection and takeover as a method of regime change. This
creates a dynamic where crisis situations continue to be resolved through
extra-constitutional means which are not predictable, weaken democratic
institutions and install leaders with questionable mandates. Thus an endless
series of EDSA’s spells serious instability.

h. Snap elections. Any call for “snap elections” would be extra-constitutional,
since there is no such provision in the present charter. What the Constitution
provides for is the holding of “special elections,” should vacancies arise in
the offices of both the President and the Vice President. Therefore, those
who are advocating this option presume that both the President and Vice
President will step down or will be made to do so. Moreover, special
elections before 2010 without meaningful preparation and electoral reforms
will only lead to a contest between those already entrenched in power and
thus will not produce genuine change.

i. Military intervention. Some have called for an interventionist role of the
military to effect regime change. While recognizing that there are reformminded
members of the military who have a genuine concern for the good of
the country, military intervention in whatever form must be eschewed,
especially in the present context of a weak Philippine democracy. Allowing
the military to become the arbiter to resolve political conflicts and stalemates
undermines civilian supremacy, long-term democratization and political
stability.

j. An Independent Counsel. Some have called for an independent institution
with the credibility and capacity for investigating and prosecuting
government corruption at the highest levels. This proposal has been made
because some see the Senate investigations as partisan, while the
Ombudsman is overloaded with corruption cases and is perceived as partial
to the government in power, given its recent track record. For this option to
prosper, however, three difficult issues need to be addressed: (i) creating such
a body through a law approved by Congress, (ii) defining the scope of its
power and responsibilities, especially in relation to the Ombudsman, and (iii)
giving it real autonomy, particularly from the President, who would be the
appointing official.

k. Impeachment. This mechanism is provided for by the Constitution to exact
accountability from the President. It is also a way by which allegations can be
verified, thus giving the President a fair hearing and an opportunity to defend
herself. However, impeachment will only work if people are willing to
participate actively in pushing for and making sure that this process is
effective (e.g. sustained lobbying, pressuring their representatives in Congress
to prioritize the search for truth and accountability). Thus, it can provide
excellent opportunities for active political participation, especially for citizens
outside Metro Manila.

“How does one go beyond GMA?”

l. Elections. The forthcoming elections in 2010 will be critical. Not only will a
new president be chosen, but this national exercise will also be crucial in the
restoration of trust in the democratic system and the emergence of a new
alternative leadership. It is imperative that they are conducted freely, honestly
and credibly. Furthermore, there is a need for responsible citizens to organize
around candidates, leaders and parties who are upright and capable, and who
can contribute positively to the strengthening of weak institutions.

Action Points

7. It is precisely during times of great upheavals and crises that the call to hope becomes more urgent. Desperation and cynicism cannot be allowed to eat up people’s inner resources. To move forward from this crisis means identifying and pursuing specific forms of action, such as: (a) joining circles of ongoing reflection and discernment, and efforts at political education and organization, including training in anti-corruption advocacy (Ehem) and active nonviolence; (b) supporting institutional efforts to get to the truth and creating a broader climate of truth-telling which encourages and protects whistleblowers; (c) joining activities that promote accountability; (d) articulating long-term ideals and policies for national political reform; and (e) establishing sectoral and multi-sectoral organizations and networks to promote dialogue and concerted action.

Concretely, eight action areas fall within the range of options which are consistent with the principles identified above, especially the need to build strong democratic institutions and promote engaged citizenship for socio-political reform:
a. Support for the ongoing Senate investigation of the ZTE-NBN case not only to bring out the whole truth on matters of public interest but also to strengthen the institutional system of checks and balances that seek to prevent the abuse of power.

b. Creation of a credible Independent Counsel , in order to ferret out the veracity of various allegations and promote accountability within the judicial system, in which unfortunately many of the official institutions are seen as severely compromised politically. Thus there is a need for an institutional venue and mechanism that will be viewed as autonomous of the government currently in power and free of the antics of traditional politicians.

c. Initiation of a genuine impeachment process, particularly by pressuring Representatives in the House to hold the President accountable for serious violations of public trust if there are sufficient bases for doing so.

d. Pursuit of reforms towards government transparency in all its transactions, especially in processes like procurement, decisions on loans, development projects, social reforms, and on issues such as mining, energy and land use that have a profound impact on poor communities and the environment. There is a need to ensure rigorous implementation of laws and policies, the institutionalization of a culture of social accountability, free access to information, and the enhanced participation of civil society in governance decisions at all levels.

e. Promotion of electoral reforms to ensure the conduct of clean, honest, and credible elections in 2010, including the revamp of the Comelec, beginning with the appointment and confirmation of commissioners of unquestioned integrity and competence; the modernization of the electoral system; the eradication of warlordism; the monitoring of campaign finance and expenditure; and the continuing political education of voters.

f. Search for worthy candidates and potential leaders, parties/coalitions and platforms for 2010, through positive preparations, planning and strategizing. This would mean clarifying political values and development priorities, candidate selection and recruitment, resource mobilization, and political organizing.

g. Organization of and support for basic sectors, to enable them to have a real say in democratic processes and to address the urgent needs of economic development and social justice.

h. Engagement of the youth in current issues, through political education, organization and mobilization for democratic institution-building, lobbying for transparency and accountability, policy reform, and involvement in electoral politics.

8. These specific and concrete calls for action are not isolated and discrete but are precisely interconnected in a framework that seeks to promote truth, accountability and reform. They address gross injustices in the country through active citizen participation that will support and be supported by efforts at political education, organization, mobilization and network-building in order to strengthen and transform democratic political institutions under the Constitution. 9. We offer these guidelines as a response to the call of our bishops for “circles of discernment” to “pray together, reason together, decide together, act together.” We trust that these reflections help clarify the context, principles and options for people – especially the youth – who seek to respond in action to the current crisis rather than succumb to the temptations of despair. For as Pope Benedict XVI has said, “All serious and upright human conduct is hope in action” (Spe Salvi 35).
